By the way, the intruder deserved to die. Anyone who breaks into another's home deserves to die.
That being said, the homeowner fails to meet Castle Doctrine here and jail time is coming.

If the intruder runs away, say the most insulting thing you can to them about their race or mom. Try to get close enough to get some splatter on you but not so close they can grab your gun obviously. A little of their splatter on you is an instant win in court, plus you got to insult them right before you off them. Winning.
