Whether or not a course is one that promotes resentment toward one race; is designed for students of one race; or that promotes ethnic solidarity "instead of treating students as individuals;" is a pretty subjective analysis isn't it?

Bingo. Its very hard to fairly regulate this law.

A few years ago, when Gray Davis was plundering CA, the leftislature was passing bill after bill to "define" hate speech. As soon as Davis was recalled, the bills stopped.

I saw the schools' chief interview on Fox News this morning while working out. You know, the whole no audio but with captions thing. It seemed like his beef wasn't so much with the idea of ethnic studies per se (though he did seem to have a problem with people studying just their own group; he wants people to study ALL groups). His big grief was the curriculum used to support the classes, which, according to him, said that the way for Chicanos to regain their "rightly deserved" power would be to repatriate everything from Cali to Missouri as the Mexican State of Azteclan or some such nonsense. Nothing to do with the great Chicano contributions to society as a whole. I wouldn't be surprised if the thing missed the late great Cesar Chavez, who forced long-needed changes in the use of migrant farm workers here in Cali.
While I could theoretically see how this could be turned into a Borg issue ("You will be assimilated. Resistance is futile."), I don't mind seeing books like that disappear. My preference, though, would be to get books that celebrate Chicano contributions to society as a whole without trying to assert hegemony.

I worked for one of the largest companies in the US and they decided to get rid of their Black History Month celebrations.
Instead, they celebrated all backgrounds.
Common sense...who is this diverse world would selfishly believe that everyone had to be subjected to a full month of hearing about one particular group's background at the exclusion of everyone else's.
