The Senate has confirmed Elena Kagan as the 112th justice and fourth woman to serve on the Supreme Court.
The vote was 63-37 for President Barack Obama's nominee to succeed retired Justice John Paul Stevens.
Five Republicans joined all but one Democrat and the Senate's two independents to support Kagan. In a rarely practiced ritual reserved for the most historic votes, senators sat at their desks and stood to cast their votes with "ayes" and "nays."
Kagan isn't expected to alter the ideological balance of the court, where Stevens was considered a leader of the liberals.

Nebraska Democratic Senator Ben Nelson was the only member of his party who opposed Kagan in the final vote. Five Republican Senators joined the Democratic majority to support the nominee: Susan Collins (ME), Lindsey Graham (SC), Richard Lugar (IN), Olympia Snowe (ME) and Judd Gregg (NH).

Good. Thankfully we haven't seen the spectacles that were the Bork and Thomas confirmations since those happened. I like to give the President a wide latitude in picking replacement judges and this clearly was not a situation where the candidate was off the rails in any way.

Lindsey Graham is a hard one to figure. Seems to vote against his own rhetoric a lot. Or else his rhetoric is so good that both sides think he is with them.dbackjon wrote:Nebraska Democratic Senator Ben Nelson was the only member of his party who opposed Kagan in the final vote. Have any of the candidates said anything that could be construed as "off the rails" since then. From what I gather, Kagan didn't give anyone insight into how she will really act, for fear of it being used against her.GannonFan wrote:Good.
