Manslaughter committed with a firearm can get you up to 30 years in FL.
I heard it explained:
With a firearm on an adult = 15 years.
With a firearm on a minor = 30 years.

Since Martin was 17 at the time, that would = a 30 yr sentence (which is basically the time of a 2nd degree charge).

Okay... how does that prove beyond a reasonable doubt the Zimmerman, with malice and depraved mind, sought to kill and subsequently killed Martin?

Here's a summation of the Florida statute to help you answer... "To prove second degree murder, a prosecutor must show that the defendant acted according to a "depraved mind" without regard for human life. Florida state laws permit the prosecution of second degree murder when the killing lacked premeditation or planning, but the defendant acted with enmity toward the victim or the two had an ongoing interaction or relationship. Unlike first degree murder, second degree murder does not necessarily require proof of the defendant's intent to kill.

State law specifically requires a charge of second degree murder if the victim dies during the commission of one of the felony crimes specified by statute. These felonies include burglary, home-invasion robbery, kidnapping, sexual battery, and a number of other offenses. To establish second degree murder, the prosecutor must show that the victim died as a result of an act committed by a non-participant in the felony. If the defendant or another criminal participant in the felony caused the unlawful killing, state law requires a charge of first degree murder rather than second degree murder."

BTW, I had Symantec on the mind since I was on the computer and it cause me to mis-spell semantics. Now, since I was an "A" student (my mom was superintendent so I can't deny it) in grammar, spelling, composition, and english, does that prove that my oversight was intentional, or simply a mistake because I wasn't paying close enough attention?
I didn't say it proved anything more than Zimm got caught lying. I don't think that they will be able to prove 2nd degree murder but once he's established as a liar the jury is going to be a lot more skeptical of the rest of his story. Like the part about getting his head smashed into the ground. Note that his professor said that not only did the Zimmster learn about the stand ground law in that criminal justice class he was the best student in the class about it. Add in his neighborhood watch training from the police and I think Zimm's cred took a hit with the people that matter.

BTW, if you were an "A" student in grammar, spelling, composition, and english, how come you put a hyphen in "misspell" and didn't capitalize "English"? :coffee:

Zimmerman Trial

Post by CID1990 »

In Florida a judge can instruct a jury that they can consider a lesser charge.

At this moment, given all the information available right now, I think this is precisely what will happen. Zimmerman will be found not guilty of 2nd degree but guilty of manslaughter. He will get that max sentence of 20-30. The sentence will be completely political. I say this because I used to deal daily with guys who have murdered other guys just like them. These guys walk free because 1) nobody saw nuttin, and 2) the victim is also black. If Zimmerman was black this would just be another forgotten story about how the most dangerous thing to a black man in America is another black man between the ages of 15-32.

This is where I'd place my bet. I think in this case the political sentence happens to be the right one. Zimmy's been a ticking time bomb just dying to shoot somebody for a long time; nobody's neighborhood needs a punk like him running around with a gun.

But they still have to prove him guilty beyond a reasonable doubt. And so far, I don't think they have come close to that. Heck, the prosecution is almost done calling their witnesses, and overall, its gone badly for them. And the defense has yet to even call any of their witnesses.

I'm no legal expert, but unless there is some new damning piece of evidence against Zimmerman that we haven't heard yet, I think the most likely outcome is not guilty of either murder charge, with the next most likely outcome being a hung jury...

Yep. A broken nose and a scratch on the back of his head that didn't need stitches. I don't know what he paid for three years of MMA training but he sho didn't get his money's worth. Likely he didn't want to live with the humiliation of getting his ass whupped by a high school sophmore. Must have been his first fistfight since violently resisting a police officer. :coffee:

We, the business owners and law abiding tax payers in Sanford and Seminole County, are terrified of what may happen if Zimmerman is found not guilty.

My wife is a native of Sanford and I conduct business there. My in laws live in Sanford in the family home of 58 years. What the liberal media and carpet bagging race baiters have done in this case us criminal. Darned right we're concerned!!!!

This whole thing is a witch hunt simply to placate the liberal media and a mob.

I know Tracy Martin from competing against him in softball. I THOUGHT he was an honorable person but he has played the race card into celebrity and hurt many people in the process.

The amount of lies and misinformation that the liberal media have put forth is staggering. I am thankful the trial has been televised so the truth can see the light of day.

It is a big deal.
