Judge considers limits on federal officers after weekend use of force on protesters, children in Portland
At a hearing Monday morning, U.S. District Court Judge Michael Simon said he expected to rule Tuesday on whether to grant a temporary restraining order that could curb when federal officers use force outside the Portland ICE building.
Protesters suing the federal government say the past weekend’s violence at the Immigration and Customs Enforcement building in Portland shows the need for a judge to limit federal officers from using excessive force on nonviolent demonstrators.
Thousands of protesters turned out for a rally in Portland on Saturday to speak-out against the federal government’s immigration enforcement crackdown. Protesters, including children and elderly people, were hit by tear gas after federal law enforcement officers fired chemical munitions at a group of demonstrators blocking the immigration facility’s driveway.

Kelly Simon, legal director for the ACLU of Oregon, said in the filing that the federal government’s main contention is Homeland Security “expressly reserved the ability to deploy chemical munitions on protesters who were nonviolent or nonthreatening, including those who were simply trespassing or engaged in passive resistance like refusing to obey an order.”

Bovino also noted that Border Patrol’s use of force policies require federal officers to give a verbal warning, when possible, and allow people time to comply before using force. In emails included in Sunday’s filing, attorneys with the Justice Department reflected a similar policy for DHS’s use of force.
But several people who attended the Saturday rally in Portland said in sworn declarations they did not hear any warnings from federal officers before tear gas or other chemical munitions were deployed.
“Agents from the ICE field office continually fired tear-gas canisters and deployed flash-bang grenades, which sounded like gunfire and created a thick fog,” Kimberly Nachbur said in a sworn statement, filed as part of the case.
Lucille Moody, who also attended the rally, said in a sworn court statement she did not witness any protesters posing a threat.
“I have attended protests in the past, and this was the most gas I have ever seen in my life,” Moody stated. “I could not breathe.”
Richard Eckman, who lives in the neighborhood and whose wife was seriously injured during an earlier protest, said he thought he would be safe “because it was a family-friendly event.”
“When later the gas detonated and engulfed the crowd, it caused me to choke and gag,” the 83 year-old Eckman stated. “I had difficulty breathing and seeing as I attempted to make my way toward home. Somebody provided me with water and helped me flush my eyes, which offered some temporary relief.”
Andrew Kihn said in his declaration that he was standing near families with children at the rally, and, like others, did not hear any warnings before federal officers used tear gas.
“I was standing next to a five-year-old girl and an elderly woman in her 70’s using a walker,” he said. “I saw the 5-year-old suffering from the gas coughing so badly, dragging behind and doubling-over as they tried to leave the area.”
The woman with the walker, he said, was disoriented and struggling to navigate the crowd.

Judge limits federal officers’ use of crowd control munitions at Portland ICE building
U.S. District Court Judge Michael Simon’s ruling blocks federal officers from using “chemical or projectile munitions,” including pepper balls, tear gas and other crowd control munitions “unless the specific target of such a weapon or device poses an imminent threat of physical harm to a law enforcement officer or other person.”
“Our nation is now at a crossroads,” Simon wrote in the 22-page temporary restraining order. “We have been here before and have previously returned to the right path, notwithstanding an occasional detour. In helping our nation find its constitutional compass, an impartial and independent judiciary operating under the rule of law has a responsibility that it may not shirk.”
The judge’s ruling also blocks federal officers from firing munitions or using weapons directed “at the head, neck, or torso of any person, unless the officer is legally justified in using deadly force against that person.”

Perversely, the growing dissatisfaction with the administration also meant that suburbanites were less likely to drive into the city to join the downtown march, since their own local protest was already drawing thousands of people. Estimated thousands showed up in the ritzy suburb of Lake Oswego. Sen. Ron Wyden (D-OR) chose to attend protests in Gresham and The Dalles, outlying satellites of Portland that lean more conservative.
Maria said that friends who had come with him to previous No Kings protests in Portland had instead opted to join protests in suburbs like Beaverton, having heard rumors of an imminent crackdown in Portland proper. “They were a bit nervous about this,” he said.
But Maria’s worries about the turnout were ultimately for nothing. By noon, as people marched from other neighborhoods to the downtown waterfront, crowds thronged the riverbanks where the cherry trees were in full bloom. The Burnside Bridge was packed with people; just north, over the sparkling water of the Willamette River, the Steel Bridge was also thick with Portlanders chanting and carrying signs. Crowds waited patiently on the banks to march the two-mile route that crossed from the west side of the city to the east and back again. An estimated 30,000 people turned out on the streets of downtown Portland. Organizers estimated that 8 million people protested nationwide.
No Kings in March 2026 broke records, records that were set by No Kings in October 2025. Eight million people is an unignorable portent for the administration. But what exactly does it augur?

Clashes in front of the building became a pretext for the attempted deployment of the National Guard; executive orders and court injunctions hinge on the facts and circumstances of what happens in the driveway of that one building on South Macadam Avenue. Much of the right wing’s apocalyptic fantasy of antifa is derived from snippets of video from the site. The scuffles on a weird little street by the Portland Tesla dealership echo throughout the nation.

There was a swarm of helmets, and it wasn’t immediately clear who was a fed and who was a protester. After being barraged so many times with munitions, the most seasoned protesters were now wearing fairly similar gear as riot cops would.
DHS, too, had had a change in costume. Even though they were, apparently, afraid of Hasbro’s lesser-known inventory, the feds guarding the building looked and behaved like professionals. Gone were the gaitered wannabe soldiers looming from the rooftop and overhang. The ICE building was previously guarded by men who were visibly indistinguishable from right-wing militia members; the newcomers were unmasked and in uniform, with patches identifying them as Department of Homeland Security.

Sure, if flying the Iranian flag, the Palestinian flag, the trans flag, the hammer & sickle, signs with ‘Fuck Trump’, ‘No One is illegal on stolen land’, ‘Trump is a ____ist’ ‚‘Trump is a ____phobe’ etc, etc are taking back American iconography,The right wing used to have a stranglehold on traditionally American iconography.
