I have never been through a specific DUI checkpoint but many years ago I was stopped by US Fish and Widlife Service agents who apprently decided I was too intoxicated to drive. It was on a Federal refuge and they had their checkpoint set up on the way out. They stopped me and when I opened my ice chest to show them my fish they saw empty beer cans I'd been throwing in there.

The end of the story is that they did the nystagmus eye test on me and told me to leave my truck at the refuge and call somebody to drive me home. I called my brother to come get me then came back the next day to get my truck.

I had to shake my head at the way things happened. First of all, it was my second day out there and I'd been drinking beer from time to time while I fished off the bank and throwing the empties in my ice chest because they didn't have any trash cans and I didn't want to litter. I think there were something like five or six empty beer cans in my ice chest but the beers had been drunk over something like a total of 5 hours on the first day and 6 hours on the second.

Another thing is a front was coming and I'd decided to quit fishing when the wind turned North. I was driving from one point to another and came to the point where I'd turn to drive out and saw them set up there. I was not concerned at all. But since I was at the road to go out I stopped my truck, opened the windows, and checked the wind direction. It had turned to the North so I decided to leave and turned down the road out.

It turned out that when the agents saw me stop my truck they thought I was doing it because I was hesitating due to seeing them set up at their checkpoint. They considered it suspicious behavior.

One thing I learned from that is I will never throw empty beer cans in my fish ice chest again.

My wife was once stopped at a DUI checkpoint and it made a bad impression on her. She and a friend had gone out to dinner. They'd each had a maragrita but had spent a long time talking so by the time they got stopped it'd been many hours.

Anyway they were driving down the road and saw a bunch of police lights. They thought there had been a wreck or something so they pulled into a parking to turn around. All of a sudden some police cars zoomed down and stopped them. My wife said they were very rude and accusatory. They had a cup of coke in a cupholder and one officer started accusing them of having an open container. Eventually things calmed down and everything was fine.

She did not like the police officers' behavior at all.

Kind of interesting to me that in both that case and in the case of my experience at the Federal refuge with the USFWS agents, the law enforcement officers involved interpreted innocent behavior as suspcisous. I wonder how frequently that happens.

But at least the USFWS agents were polite. According to my wife the local police officers she ran into on that night were not nice at all.
