If capital punishment could be executed swiftly you would be correct. We had 2nd degree murder case. No weapon found, no motive. Only witness was in the front seat of the car and didn't see the shot from the back seat to the person's head, reaching under the drivers seat for the pot. Witness was from E St Louis with a long list if offenses. Told the video interviewer that he hadn't gotten in trouble in Minnesota except for that sh it he went to jail for. Defendants phone records matched his story and claimed the witness held a gun on him and made them burn the car with the body. Most of us thought the witness committed the murder, but he wasn't on trial. Took a day and a half for everyone to agree on the acquittal. I used to be hardcore for the death penalty when I was younger.
Now I'm on the fence. I wonder if life in prison wouldn't be better- a worse punishment for this guy.
That said, he is obviously someone who can never be free to roam, ever again- and that begs the question if it is appropriate to keep him alive until he dies naturally.
Being against the death penalty seems to be the easiest position to defend from the moral and libertarian standpoint, but it gets less so in the pragmatic, utilitarian view.
