VA AG To Colleges: You Can't Ban Gay Discrimination

RICHMOND, Va. — Virginia's attorney general has advised the state's public colleges that they don't have the authority to ban discrimination based on sexual orientation, saying only the General Assembly has that power.

The letter sent by Attorney General Kenneth Cuccinelli to state college presidents and other officials Thursday drew swift criticism from Democrats and gay rights activists.

Cuccinelli said the legislature has repeatedly refused to exercise its authority. As recently as Tuesday, a subcommittee killed legislation that would have banned job discrimination against gay state employees.

"It is my advice that the law and public policy of the Commonwealth of Virginia prohibit a college or university from including 'sexual orientation,' 'gender identity,' 'gender expression,' or like classification, as a protected class within its nondiscrimination policy, absent specific authorization from the General Assembly," Cuccinelli wrote.

The Republican advised college governing boards to "take appropriate actions to bring their policies in conformance with the law."

Finally, an Attorney General who follows the law... :nod:

The legislature makes laws...not administrators...

The AG enforces the laws created by the law makers...

That's what the Constitution of the United States and the Commonwealth of Virginia calls for...

Show me in the laws of Virginia or the United States...or in the Constitution of the Commonwealth or of the United States...where the Attorney General has violated anything with his ruling...

And for the record, I think the House of Delegates and Senate are wrong in not passing the appropriate legislation...but in its absence...

So should the law be, "no one can be discriminated against because of how they are born"?.... you will have a hard time passing that, what with stupid being a quality given at birth and all. Not that the laws are right in excluding gay people from the protected group, but you also can't circumvent law just because you want something done. For now the nondiscrimination policy is where it is, hopefully it is changed asap, but you can't enforce laws that don't exist.

It's the AG's opinion. What would happen if the universities ignored his advice? Who would be harmed? Does the state constitution single out "sexual orientation" but condone ban's based on race?

Seems like some stupid advice from the AG. :thumbdown:

What makes it his opinion? The fact that he is advising? I advise you to not walk on thin ice. Not my opinion, just the right thing to avoid doing. You need to do more research into the laws before speaking. It isn't that "sexual orientation" is singled out. Sexual orientation just isn't included in any laws yet, therefore cannot be enforced. Race, gender, nationality, age, are all included. However, the laws are somewhat outdated and need updating. The public school is a school of the state, therefore they must abide by state laws. Thus the AG's LEGAL advice.

Bad analogy. The university is PART of the state government. I don't think Rosa Parks worked for the bus system.

She didn't even normally ride the bus..........she was planted by MLK, Jr.'s people. Claudette Colvin was the first woman arrested. She didn't make a good spokesperson though - because she was a pregnant teenager...and that is your random fact of the day.

I think my major point...one that jon ignores...is this...

To fix this country, we need to get back to politicians making or changing laws...the executive branch enforcing those laws...and the judicial branch judging the constitutionality of those laws...

Right now we have weak politicians...executive branch people making ruling on what they feel the law should be...and judges making ruling on what they feel the legislative branch should have said in a law...
