Federal court rules against military gays policy

SEATTLE - The military cannot automatically discharge people because they're gay, a federal appeals court ruled Wednesday in the case of a decorated flight nurse who sued the Air Force over her dismissal.


The three judges from the 9th U.S. Circuit Court of Appeals did not strike down the military's "don't ask, don't tell" policy. But they reinstated Maj. Margaret Witt's lawsuit, saying the Air Force must prove that her dismissal furthered the military's goals of troop readiness and unit cohesion.

The "don't ask, don't tell, don't pursue, don't harass" policy prohibits the military from asking about the sexual orientation of service members but requires discharge of those who acknowledge being gay or engaging in homosexual activity.

Wednesday's ruling led opponents of the policy to declare its days numbered. It is also the first appeals court ruling in the country that evaluated the policy through the lens of a 2003 Supreme Court decision that struck down a Texas ban on sodomy as an unconstitutional intrusion on privacy.

When gay service members have sued over their dismissals, courts historically have accepted the military's argument that having gays in the service is generally bad for morale and can lead to sexual tension.

Now maybe the US can take steps towards becoming a civilized country, and join the rest of the first world in allowing gays to serve openly in the military.


Maybe even the arabic translators who were drummed out of the military can be asked back to alleviate the shortage of qualified translators.

There were several (I don't know the number) of Army troops going through language school for Arabic who were discharged...They are gay...(Their claim, not mine)

I don't know the circumstances of how this was discovered, but due to the huge lack of Arabic translators, it has become a rallying point for those supporting openly gay military members...

Huh...

So, is the military's reason gays couldn't perform duties as translators have anything to do with their lisps?

(...I know...this is supposed to be a serious discussion...but you have to admit, the "Don't Ask. Don't Tell" policy is one of the dumbest govt. policies to ever be codified.)

Clinton wanted to lift the ban completely. DADT was a step ahead of the previous complete ban.

perhaps not. perhaps military people and not judges should be in charge of booting fags out. they undermine the good order and disclipline of our forces and sap our fighting strength. the Army is not a social engineering lab it's the godamn Army and we don't want or need gaywads in the ranks.
