School District blames Disabled Child for Own Molestation

Just came across this story. My God what's wrong with America these days:

When a teacher's aide at Saddleback High School in Santa Ana, CA was arrested for molesting one of the special-ed students under his care, the school district's first impulse was to cover the incident up and hope no one would find out...
...The seventeen-year-old victim, who has cerebral palsy, has the mental capacity of a seven-year-old and is confined to a wheelchair. Because she is unable to speak, no one knows exactly what was happening when another school employee found her alone in a room with Alonso Manuel Gonzalez, with her shirt pulled up and her breasts exposed, but the incident resulted in the aide's arrest for a "lewd act with dependent adult..."
...Now, a year after the aide's guilty plea, the parents of the student have brought a civil suit against Gonzales for causing mental and physical trauma to their daughter and also against the school district for negligence. As a result, the district's lawyers are fighting back -- hard.
In a filing with the Orange County Superior Court, the attorneys claim that the wheelchair-bound girl "chose to encounter the known risk" of being alone with Gonzalez, that she "consented to" him lifting up her shirt, and that her injuries were the result of her having "failed to use due and reasonable care for her own safety and protection."

Uhh......yeah it's the administrators fault the lazy fat video game playing kids of today won't study and get good grades.

Majority of em are getting a good education.
The republicans favorite punching bag is public education. They want to take it away from government and put it in the hands of fundamentalist christians. So what they do it do is get elected on the God, Gays, Abortion & Gun platform, then eliminate funds for public education until schools suffer and fail, then blame the failure on teachers unions, then go on very public crusades ridiculing public education and clamoring for funding for parochial schools and church programs.

The republicans favorite punching bag is public education. They want to take it away from government and put it in the hands of fundamentalist christians. So what they do it do is get elected on the God, Gays, Abortion & Gun platform, then eliminate funds for public education until schools suffer and fail, then blame the failure on teachers unions, then go on very public crusades ridiculing public education and clamoring for funding for parochial schools and church programs.

I'm not a Republican and I'm agnostic, yet I would like to see the Department of Education dismantled. How do you explain that?

First, let me congratulate you for not being suckered into violence and fairy tales by rejecting the republican party and organized religion.

Okey dokey, I cannot answer your question until I know more, regarding your position above. I don't think anyone here would say our education system is perfect, but where I live, it's outstanding and I'm proud to support it, even though I don't have children, that I know of.
Say, I'm starting a cs.com softball league. Are you interested? Our first game is in St. Louis and so far I have 1 player signed up (catamountman). Let me know if you will be there. I can't play due to an infected hair near my belly button.

No, but when they suspend kids for self-defense under the guise of "zero tolerance," and try to act like the school system and all the teachers are perfect, fight against standardized testing, school choice, etc...then I have issues.
