Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license. Indeed the evidence shows Proposition 8 does nothing more than enshrine in the California constitution the notion that opposite sex couples are superior to same sex couples.

I have a feeling that this decision and the timing by which it will reach the US Supreme Court renders a second Obama term unlikely. This judge just held that there is a right to gay marriage protected by the US Constitution. That is going to bring out a social conservative backlash and they will be many, many single issue voters casting votes in the 2010 congressional elections and the 2012 presidential election.

There is no rational or legal basis to overturn this decision. If they do, they will go down next to the Dred Scott justices as the worst in US history.
He did say in Lawrence that state laws criminalizing sodomy had no "rational basis," but he quite obviously emphasized the criminality of the prohibition. Not per se ... but it would create grounds for any affected party within Ninth Circuit to challenge a state law which restricted his or her right to marry a same spouse partner, and the decision would be binding. I can't see any way for another court to reason around the Ninth Circuit's decision, assuming the Ninth Circuit adopts the same reasoning as the District Court and does not limit it in any way. Correct me if I am wrong, but if the 9th Circuit upholds the verdict, Gay Marriage would be legal in every state covered by the 9th Circuit.
