The Government's New Right to Track Your Every Move With GPS

Government agents can sneak onto your property in the middle of the night, put a GPS device on the bottom of your car and keep track of everywhere you go. This doesn't violate your Fourth Amendment rights, because you do not have any reasonable expectation of privacy in your own driveway - and no reasonable expectation that the government isn't tracking your movements.

That is the bizarre - and scary - rule that now applies in California and eight other Western states. The U.S. Court of Appeals for the Ninth Circuit, which covers this vast jurisdiction, recently decided the government can monitor you in this way virtually anytime it wants - with no need for a search warrant.

No one is making you drive a car or use a cell phone. Just don't drive, don't carry a cell phone, don't use anything electronic and don't let anyone shove anything up your butt! :) The fail-safe way to avoid being tracked by the gubment.

Didn't the DC Court of Appeals just rule the opposite way in a similar case, basically saying that you do need a warrant to install a GPS tracking device? Obviously, if two different appellate courts have gone in two different directions, this one will be likely bound for the Supreme Court. Hard to see the current make-up of the SC agreeing with the 9th Circuit in this case.

Yes. It's referenced in the article as well. A shame this has to go to the supreme court.

Eh, sometimes it's good having the SC give an issue real clarity - of course, they don't always do that, but this one seems teed up quite nicely for them to do just that.

Sounds like an extension of the Patriot Act - why aren't all the raging libs on here going nuts about this?

the gubmint already tracks everyone's gps location, as well as collecting their fingerprints and DNA samples.
that's why pennies are still in circulation. duh. :ugeek:

Because by the time the likes of us get around to discussing it, it's already a done deal. If they can do it, they will do it, regardless of what any court says. It's already too late to do anything about it. If you want to read a cool novel that deals with this very subject matter check out Diamond Age by Neal Stephenson.
