Former MADD Leader Arrested For Drunk Driving

....former Gainesville Mothers Against Drunk Driving chapter president Debra Oberlin was arrested for, you guessed it, drunk driving in Gainesville.

Pulled over for veering across lanes of traffic at about 1:10 a.m., Oberlin had bloodshot eyes and smelled of alcohol, according to the incident reports. Oberlin failed a field sobriety test.

Oberlin's blood alcohol level was then found to be between .234 and .239 according to two Breathalyzer tests, though she says she only drank four beers before hopping--or more likely, stumbling--into her car.

This should warm JSO's heart some.
Well, I guess there's some justice in the fact that this woman...who did not hurt anyone nor engage in any intent to hurt anyone...is now going to have to go through the hell she helped create for millions of other people who had their lives destroyed when they never would have hurt anyone by virtue of driving under the influence (some would have, but the overwhelming majority wouldn't have).

But it doesn't change anything. It doesn't change the fact that millions of people are going to have to go through that hell based on the idea that any BAC at or above 0.08 creates a substantial risk along with the idea that breath testing devices and field sobriety are reliable enough to be used like they're being used.

At least, if she really was anywhere close to 0.24, it was really "drunk" driving. Even given the imprecision of breath testing devices and the possibility of police officers obtaining upwardly biased results by browbeating subjects into exhaling every bit of breath out of their lungs there wouldn't likely be enough error to suggest that she wasn't really drunk.

That's as opposed to seeing someone characterized as driving "drunk" because they blew something between 0.08 and 0.10 on a breath testing device. Most people are not, by any reasonable understanding of the term, "drunk" when their true BAC is 0.08.

JSO, do you know where the 0.08 level comes from?

Do you know where the impetus to get your "upwardly biased results" come from?

Do you see the veritable downpour of irony here?

The "hell" that these people go through was created SOLELY by the MADD lobby. In fact, the onerous parts behind the various DUI laws can be traced directly to the pressure put on local, state and the Federal government by the MADD lobby. Additionally, as a former police officer who has been there and done that, NEVER EVER let a DUI go and have someone find out about it. MADD will make sure you lose your job, especially in departments down south where there are no civil service protections.

I had MADD up my ass on a couple occasions because I used to have borderline cases call a friend to come pick them up, and then I'd have them 'agree' to have their car towed so they don't get out on the road again until sober. You cannot cut breaks in DUI cases and be sure that your career is secure while MADD is around.

Yes, if I'm understanding your question directly, I know MADD is played a major role in creating the witch hunt atmosphere and was a major lobbying force in reducing the legal limit from 0.10 to 0.08. But I think the Federl National Highway Traffic Safety Administration was a factor as well. Also the whole culture of "traffic safety" professionals. I've gotten to the point where I tihnk we'd be better off on balance without these people. They look at their job as reducing traffic fatalities and no matter how much traffic fatalities are reduced they'll continue to say "that's not enough" and push for taking sometimes draconian action (like more severe penalties with "education" to intimidate the public).

Agree. I've always lived by the adage that if you're going to fok up, do it at 110%...don't half-ass it....I never blew below a .14 and topped out at .22 I believe...so I give her credit for giving it her all... :thumb:

Don't the penalties get worse when you get in that range? I thought I remembered that NC had some laws that made a BAC in excess of some arbitrary number subject to higher penalties?

I think there should be an optional drunk driving test. You drink a few beers (provided by the DMV, of course) drive around with an instructor. If you pass, your BAC is taken. You drink a few more beers, drive around with an instructor. Etc. Once you are deemed to be an unsafe driver you get cutoff and your driver's license reflects the BAC you are allowed to drive with.

It's stupid that because some idiots get falling down drunk and flip their car after 3 beers... that it's now illegal for me to drive after 3 beers... when I barely have a buzz. :evil:
