Yes, they had a responsibility to keep Gray safe while in custody. But responsibility only extends to a degree thay the police are acting REASONABLY to provide protection.
If...

...IF... Gray was intent on injuring himself during transport, a premise supported by the other arrestee's statements, then the question becomes whether the transporting officer took reasonable steps to prevent Gray from harming himself. The "duty" to protect is not absolute: E.G., the transporting officer has no obligation to pad the compartment with goose down feathers, nor risk his own safety, to ensure Gray is safe.

You may disagree, but the courts will settle this matter.

How about a side wager?

There are really two relevant issues:

BTW, much of the investigation has been withheld from the press. Leaks indicate Gray fled to the housing project, ditched some form of contraband (drugs/gun), then returned outside to taunt the officers.

Not that this theory would change (justify) the outcome, but like the Michael Brown shooting, the narrative that Gray was some saint indiscriminately harassed and abused by police, is a myth.

Doesn't matter to me what drugs he had in his possession or things he dumped. Doesn't matter to me that this guy was a loser and a depraved individual. Once they placed him in that van it was the police's responsibility to get him where they were taking him safely and they didn't do it and they consciously didn't do it. They should and will be punished for this lack of fulfilling the duty as police officers. Even if the guy that died was worthless.
Baltimore City Police had just(like 1-2 months prior) made it mandatory to seatbelt prisoners. So the practice was fairly new. It was made mandatory due to the fact the prisoners were injuring themselves to delay getting put into Central Booking. He died 7-8 days later, so it wasn't like his dumb ass showed up dead at stop 5.

As long as it doesn't show up on film the cops will be OK. Even if they get the sack they'll just move on down the line to a place where where the upright citizens appreciate someone who don't take no shit from no scumbags.

Brady evidence released to defense...fellow arrestee Donta Allan on video telling police that Gray had gone "crazy" in the back of the van, was slamming around trying to hurt himself.

...then, next day, tries to deny he talked with police.

Shit is going down it looks like regardless of the jury saying guilty or not guilty. Police are being sent in from all surrounding counties and assembling in Patterson park for the last three days. "Staging"
