Court declares NC Congressional Districts UNCONSTITUTIONAL

RALEIGH — Federal judges struck down late Friday two majority black congressional districts in North Carolina, saying race was the predominant factor in drawing those lines but state legislators lacked justification in using that practice.


Two of the three judges on the redistricting panel hearing the 2013 lawsuit agreed the size and composition of both the 1st and 12th Districts violated the Constitution's equal protection provision and must be redrawn.


The judges ordered the General Assembly to come up with new boundaries by Feb. 19, although Republican lawmakers who helped shepherd North Carolina's congressional map through the legislature in 2011 said a swift appeal was coming. The state could seek a delay at the 4th U.S. Circuit Court of Appeals.

Some of the most gerrymandered congressional districts in the country are in NC and they are slanted towards black voters.

I have been consistent in my opposition to gerrymandering from any party.

That isnt what I asked you, Jon-

so let me ask again in a different way:

Since NC is one of the most gerrymandered states, would you support redistricting along population lines?

NC is gerrymandered because the districts were drawn by people who think like you, so you can't be against gerrymandering if you are looking to manipulate outcomes in favor of black citizens.

I lived in gerrymandered District 12. There was really no point in even voting.

Huh? Really? You do know that, technically speaking, crafting a voting district to contain a certain number of voters (whether it be a party, or a class, or a race, or some other criteria) you are in effect gerrymandering? I suppose it's good or bad depending on your point of view and what you're doing, but it's still gerrymandering.

North Carolina 12, just like Virginia 3, were created by Democrats to elect black Comgressmen or women (read Democratic for the uninitiated). The Republicans just enhanced the procedure when they got the chance after the next census.

Well, the US is busy cramming as many liberals as we can into California and New York effectively suppressing the Republican vote.

This.

A minority majority of anything doesnt fall under the facts of the demographics of this country.

It would be interesting to see congressional districts divided strictly along ethnic percentages, and how the maps would be drawn.

Every district would be majority white...but that would be racist :coffee:

This. NC 12 was established a long ways back. Glad it was thrown out. Now if they would do something about NC 10, I'd like that as well.

This should be the way it is done in every state.

Every census the numbers (without any accompanying demographic data on age, sex, race, class, income, etc.) should be entered into a GIS and districts are spit out based solely on the distribution of people.

That is a really dumb idea.

A surrounding farm district would be at the mercy of a large city next door. The two groups have little in common, but the majority of people crammed into in a 10-square mile area would completely dominate the political, and thus, financial, decisions for hundreds or thousands of square miles.

Heck, why don't you just eliminate state and county lines and simply divide people up simply by numbers? Hey, let's do that for the world, also. The Chinks and Dot People know what's good for the rest of the world, right? After all, equality and elimination of individuality is paramount...we need to leave no reminders of any particular group of people or their particular needs. :dunce:
