God dammit!

Very bad news for those wanting to maintain even a remote semblance of Constitutional government. The Republicans need to just make it known that they will not approve anybody Obama nominates. Just say it's not happening and that the next President will fill the vacancy. We'll see if they have the guts to do it. The nation needs for them to show some courage and not let that guy get another "I don't give a shit about the Constitution" justice on the Supreme Court

Time to get a real Justice in now.

IMHO, there are two outcomes here (whether it's an ugly confirmation process or not): Obama will significantly shape the Court for years to come with the appointment of a liberal judge. Or a centrist judge will be appointed.

I think as masterful as Obama has been flexing his Executive powers over the fractured Legislative branch, he's going to face a united Republican Senate and a liberal judge will not get through. From the start, Obama will realize he's up against a wall here and he's going to nominate a fairly non-partisan judge.

While it's in their power to do so, the Republicans will look horrendous if they make it ugly and draw it out until the next Presidency. The media and public, rightfully so, will turn on them. It'd be political suicide for the Republicans in an election year and so I think Obama will get his third appointment.

I don't think the Republicans will look ugly if they just lay their cards on the table and say straight up that they are not going to allow Obama to fill that position. I mean, they'll look ugly to people who would never vote for them anyway. But I don't think they'd hurt themselves politically. Just say, "Look, we are not going to let this leftist President shape the court for decades to come by filling this position. This is too important. It's going to be the next President."

And that is totally legitimate. It's the way things were designed to work.

I think they'd be fine if they did that. We'll see if they do.

And it should be if that's what the people in your State want. And I wouldn't put it that way anyway. The way I'd put it is that if the people of your State don't want to recognize a homosexual relationship as "marriage" they should be free to opt not to recognize it as such. Honestly, I don't know why homosexuals think other people should be FORCED to validate them.

I simply think that the Republicans need to be VERY careful maneuvering this process in an election year, especially if they want to block all appointments. I don't know all the scenarios, but I can foresee such a plan easily backfiring. And energizing the left.

edit: Also, I don't think any judge is truly liberal or conservative. They're mostly center with one leaning or another, but not some crazy leaning like each side makes it out to be.

I think that the only people they would alienate if they just absolutely refuse to allow Obama to fill that position is people that would never vote for them anyway. I think the people that WOULD vote for them would be thrilled if they just say up front that they have the Constitutional power to keep Obama from being the one that fills that position and that that's what they're going to do.
