USCIS grants you an I-601 waiver of your ineligibilities .... almost a textbook rubber stamp- making marriage to a USC matter more than anything. Because USCs have rights - to lots of things... like petitioning for their foreign spouses

And if you came on a duration of status visa, you dont accrue unlawful presence until DHS adjudicates you to actually be out of status

So unlike someone who walks across the border, it is entirely possible - probable even - that Melania Trump has never had an immigration violation.

I don't think her loving marriage is where the validity is being challenged
I think the issue being that she lived here before she was married to our great and honorable President
and received a type of waiver that the president is trying to remove...

I just though it would become an entertaining distraction
from the nothing berger of the investigation

Now that may well be true - about the waiver. And it would be very unfortunate if she did receive a waiver (disclosure: all spouses do for simple unlawful presence)

But I have a strong suspicion that she was on a “duration of status” visa. If that is the case, then it’s unlikely she ever accrued unlawful presence, and therefore would not have needed a waiver.

I certainly hope that is the case, because our waiver regime definitely does need an overhaul and this would muddy the water for reform.
