11-Year-Old Georgia Girl Ordered to Leave U.S. for Poland Ov

The last thing 11-year-old Ewelina Bledniak of Cummings, Ga., had in mind for her summer vacation was a deportation fight.

But Hubert and Agnes Bledniak's daughter, who has been in the U.S. since she was 2 years old, faces getting thrown out of America if she doesn't "voluntarily leave" the country by July 23.

If she doesn't go "home" to Poland — a country she hasn't seen since she was a baby — on her own, she'll be sent back involuntarily and not allowed to return for 10 years.

Ewelina's family came to America in 1999, and her father has become an American citizen. Her mother, a permanent resident, also is seeking to become a citizen. But because of a lawyer's mistake eight years ago, according to the Bledniaks, Ewelina can't stay in the U.S. with her parents.

The Bledniaks say their lawyer failed to file the proper documentation for Ewelina back in 2001 — a mistake that stayed under the radar until the family applied for their daughter's green card. It came back denied, automatically putting Ewelina into deportation proceedings.

"She didn't do anything wrong," said Hubert Bledniak, who moved to Cumming, a small town about an hour north of Atlanta, in 1999 and owns a tile installation business. His wife, Agnes, works at a restaurant.

That is incredibly f'd up. I hope the article will generate enough publicity to elicit some common sense from someone with the authority to fix this.

if they lived somewhere other than georgia, i'd expect a Congressperson or Senator to step in and fix it.

Ol' Rob is proud to say that he is enslaved, er married, to a Polish woman (2nd generation - 100% Polish - farm girl from Central Wisconsin - Cap'n Cats' neck of the woods if you can believe that, unless he's moved in the last few months) and can vouch for the busty part.

Not true hommie, I work with someone from Holland who encountered this same problem... someone here US messed up, not him... His wife and kids were fine to stay, but if he hadn't gotten the problem fixed he would have been deported and not allowed back in the US for 5 years. He appealed to one of our state senators in Georgia and the senators office got it worked out.

(CNN) -- Eleven-year-old Ewelina Bledniak was looking at a year split from her parents, split from her friends, away from everything she loves about living in America.

The federal government was ready to deport Ewelina to her native Poland because when she was 3 years old, the family missed a deadline to file a key immigration document.

"I love going to school here, and my friends, I'm going to miss them," Ewelina said as she worried about being deported. "I like living here."

But things are looking up. An Immigration and Customs Enforcement attorney last week asked the U.S. Immigration Court in Atlanta, Georgia, to reopen Ewelina's case and terminate the deportation proceeding ICE had initiated. The motion asks the court to send the case back to U.S. Citizenship and Immigration Services for resolution.

"They seem to be willing to find a favorable solution to this matter," said Ewelina's attorney, Maria Odom of Atlanta. "... It's good news for the child, absolutely."

If she wants to stay, she should look up Elian Gonzalez's cousins in Miami and claim she's from Cuba...

Besides, it was Bushs' fault the the parents screwed up the immigration papers in the first place.
