Fate of Sioux Nickname starts in a few hours!!

I would like to see this issue in the rear view mirror.

North Dakota needed to convince 2 Sioux tribes of 7000 and 8000 people, plus some Chippewa, and only got one Sioux tribe to agree. It is time to move on.

And it was a lousy political trick by NDSU supporters in the legislature to put UND in the bind they did.But worst of all is having to endure the ludicrous remarks of Lakes Bison. Unfortunately, this one isn't going to end.

Wrong, you can't point the finger at NDSU supports for any of this and I'm guessing most UND fans would agree. Who was it that asked nickname supporters to email their elected representatives to vote for this bill? I'll give you a hint, it wasn't anyone from NDSU. One needs to look no further than the head hockey coach at UND. According to those in Bismarck, their emails were flooded with support for the nickname bill. Most Bison fans will tell you they knew this bill was going to be an epic fail but the save the name at all cost hockey fans at UND made this happen. Heck even last week a local political hack blogger who I would consider leans toward all things UND was urging people to email their reps to keep the name and said blogger has no love for NDSU. So while things get way out of hand when it comes to the two schools on boards like this, I wouldn't be so quick to point the political trick finger at NDSU supports in the legislature on this one because it just isn't true.

Please keep us updated on current developments at this N.D. Legislature special session regarding the nickname issue. I assume that Dr. Kelly will make a presentation. My knowledge of UND is basically limited to the School of Health Sciences but I feel UND is in excellent hands with the leadership of Dr. Kelly. I find him to be articulate, well read and a statesmanship presence reminiscent of a Dean Rusk, Henry Kissinger or Colin Powell.

BISMARCK — Legislators considering a bill to repeal the state's Fighting Sioux nickname mandate are looking at a proposed amendment that would require a “cooling off” period before any new nickname or corresponding logo could be adopted.

“I'm glad we tried” to save the Fighting Sioux nickname by passing the law during the regular 2011 session, Rep. Stacey Dahl, R-Grand Forks, told members of the House and Senate education committees as she offered the amendment.
"But we face a different set of facts now," she said. "There is a deep sense of loss and sadness that really can't be dismissed," and a moratorium on a new nickname would help.
"Let's let everything settle," Dahl said, before moving on.

But there is this crap being thrown in for consideration:

A second amendment, offered by Rep. RaeAnn Kelsch, R-Mandan and chair of the House Education Committee, would repeal the law but would state that UND can't adopt a new nickname until all litigation on the subject is settled.

House Republican Majority leader Al Carlson has another amendment to block the university from dropping the nickname and logo until all lawsuits over the issue have been settled. Espegard calls Carlson's proposal "wrongheaded." The committees will vote on the amendments later Tuesday.

I agree with clenz, though probably for a different reason.

I think UND ought to go without a nickname and a mascot, at least for a while, because that is the one rock you have to throw back at the NCAA. If you get on TV a couple of times the next couple of years in a couple of different sports (for example, an FBS game), the announcers will talk at length about WHY you are the only Division I program with no nickname, as well as who did it to you and what their reasons supposedly were. During this period you would train your coaches, staff, and athletes to memorize and respond to any interview questions about this with something like "the NCAA required us to stop using our historic nickname. I have no other statement to make about it at this time." The day you pick a new nickname is the day the NCAA declares final victory. I think it's unlikely that they would go so far as to ban you from competition simply because you have NO nickname.

If you look at Section 2(d) on p5 of the settlement, it states "If UND does not adopt a new nickname and logo, or if the transition to a new nickname or logo is not completed by August 15, 2011, then UND will be returned to the list of institutions subject to the Policy". Now, to me this says that if UND does not adopt a nickname, they will still be on the list. However, at least progress would be made with the nickname dropped and the Big Sky would be more comfortable with UND being in compliance with the policy. However, it could also mean that UND may not get home playoff games until a new nickname is picked. It is possible that the NCAA could back off that part of the settlement and take them off the list completely, and maybe even say it's ok to follow a law like that as long as UND has a new nickname in place by 2015 or whenever. But, I'm not much for legal jargon so maybe I'm reading it wrong. Here is a link to the settlement.

Good catch, Hambone. I hope that paragraph doesn't mean UND actually agreed to eat the full sh!t sandwich. The definition section on the first page makes clear "the Policy" means the NCAA policy that prohibits Native American nicknames, logos, and images. I haven't seen the Policy but I doubt it affirmatively requires you to have a nickname, logo, or images. It would be a stretch to interpret the settlement agreement as creating a UND-only amendment to the Policy that says not only will UND NOT have a Native American nickname, logo, or image, but that it will also eat the full sh!t sandwich and pick some other nickname.
