The cross examination of the accuser continues again tomorrow at 9:00 MST.

In my opinion, the defense has been winning the trial handily. Like most who knew the specifics, at this point, this trial should have never happened. Indeed.
Some highlights:
The exchange between Paoli and the accuser's roommate was absolutely brutal. He basically got caught lying about information that he said before regarding how he thought the girl was exaggerating. Wouldn't have been a big deal had he just admitted it, and said he was wrong at the time, but he denied it until Paoli read his statement back to him. The prosecution really tried hard to object and give context, but was dramatically overruled by the judge at the end.
Pabst questioned the expert the prosecution brought in to testify about her mental state, and he revealed he never even met with JJ or the accuser at all before giving testimony. However, based in his expertise, the weird behavior of the girl after the fact is consistent with other rape victims, and doesn't hurt her credibility.
Accuser still stands by the accusation that JJ assaulted other girls, yet still hasn't shown any evidence of any kind.
Still a lot of trial left. Consensus is that JJ will take the stand at some point. After seeing everything so far, the state may need some bombshell to turn this back around. In a purely litigatory sense, Johnson's defense team is looking strong and incredibly prepared.

Your discussion of this trial has me wondering:
If the trial proceeds to its conclusion as you describe it going right now, it appears that Johnson will be exonerated. If that's the case, does he go back to the Griz? Does he try for a fresh start elsewhere? And, more importantly, what happens to that Griz witch-hunt artist at the local paper who tried to make a name for herself over this? An acquittal sure makes her look stupid....

SuperHornet's Athletics Hall of Fame includes Jacksonville State kicker Ashley Martin, the first girl to score in a Division I football game. She kicked 3 PATs in a 2001 game for J-State.

Well, I don't want to jump to any conclusions, since all it takes to nail JJ is if one other girl comes forward with a similar experience like the accuser says, with evidence. So this case isn't exactly shut yet. The prosecution, despite their apparent shortcomings thus far, still has a lot of time to surprise everyone. As I understand it, if given the chance to come back, JJ has told people (privately??) that he would try to play again (just what I've read on eGriz), and likely wouldn't move. If he moves laterally, he'd have to sit out a year, and could only play one after that, and I doubt he'd move down just to play two years if given the chance to stay.
Side note: Pflugrad is the new OC at Weber State, and it kills me. I'm so happy for him to get another shot, but this Griz team is still largely his team. If JJ is exonerated, by some miracle I'd love to see Pflu back in Missoula.
Edit: As for Florio, I doubt anything will happen to her. She did her job and sold newspapers, and made this a huge issue. A lot of Griz fans yelling slander and libel don't really have anything concrete to base that accusation on. JJ wouldn't be able to sue the Missoulian, if that's what you're implying.

Note - there is a difference between "Not Guilty" and "Exoneration"

And about the conduct code, his expulsion was suspended until after the results of the trial. It's true the burden of proof is different, but why would they suspend it until after the trial?
If they wanted to expel him, they already would have gone through with it, IMO.
This is all assuming he's found not guilty. If it's a hung jury, they might very well move to expel him.

I think a bigger question than whether or not Montana would take Pflu back would be if he would accept if they did. After the way they treated him (in his mind, at least) with no justification whatsoever. Not many people would.

Wasn't there a judge that said the Student court violated his rights severely, and if JJ wanted to sue, he would have a pretty solid case. Something along the lines of JJ getting a letter three days out from his appearance that if he had legal representation, he would need to notify the court five days out? Apparently it was said at the trial that JJ is still enrolled in classes at UM, which means he'd be able to join spring drills if acquitted.
Still doesn't mean he'll play, but puts to rest the WSU transfer rumors.

I'd be surprised if it wasn't an acquittal. The prosecution hasn't proven anything (things were at most a wash before the defense even started presenting their case), so a conviction would be shocking. And hung juries aren't common—there would have to be at least one juror that staunchly & inexorably believes to the very absolute core of their being that JJ is guilty, otherwise they'll give in to the majority eventually (I'd be quite surprised if acquittal isn't the majority position).Grizalltheway wrote:I predict a hung jury. The jury probably has some griz fans and I doubt they'd vote a griz qb guilty. This guy is a rockstar in a hick, inbred town. This criminal will get off and be back on the field in no time.
