A player shall be considered a rookie unless, during a previous season or seasons, he has (a) exceeded 130 at-bats or 50 innings pitched in the Major Leagues; or (b) accumulated more than 45 days on the active roster of a Major League club or clubs during the period of 25-player limit (excluding time in the military service and time on the disabled list).

I'm fully aware of when rosters expand. But those two parts (a) and (b) are mutually exclusive. Either (a) he has not exceeded 130 AB's or 50 IP, OR (b) accumulated more than 45 days prior to the rosters being expanded. Right with what you posted. section b. the 25 -player limit ends at midnight on September 1 when any player on a teams 40 man roster can be on the active roster.
