No, that's not true. You can buy a BLM flag and you can burn it in protest and be protected by the 1A. You can't go onto private property, steal a BLM flag, and then later burn it. That's destruction of property. That and having in his possession illegally two large capacity ammunition clips. It's the details that got him.
I wonder how many U.S. flags were stolen from private property, then burned. I wonder how many people served time in prison for doing just that.
Six months for stealing and burning a BLM flag, while BLM and Antifa burned down large chunks of cities last summer. How many of them served time? How many were caught and released?
Apples to oranges a bit but here’s one example BLM sentencing. 46 months for brandishing a weapon. Sounds like they’ve been prosecuting both sides based on the available laws if that’s what you’re driving at.
“The Department of Justice stands firmly against anyone and everyone who seeks to instill terror and encourage violence,” said Acting U.S. Attorney Prerak Shah. “This sentence sends a clear message that our office will continue to work with our law enforcement partners to apprehend and charge all violent instigators, while protecting those who want to lawfully exercise their constitutional rights.”
“Together, our local, state, and federal partners work to protect those participating in legitimate, peaceful protests,” said FBI Dallas Special Agent in Charge Matthew J. DeSarno. “The intimidating and violent behavior exhibited by Mr. Quinones while individuals exercised their First Amendment rights has been swiftly answered with today’s sentence.”
