Gray was intent on injuring himself during transport, a premise supported by the other arrestee's statements, then the question becomes whether the transporting officer took reasonable steps to prevent Gray from harming himself. The "duty" to protect is not absolute: E.G., the transporting officer has no obligation to pad the compartment with goose down feathers, nor risk his own safety, to ensure Gray is safe.
You may disagree, but the courts will settle this matter.
