Nice try, "smart" guy. Read Yale Law professor Bruce Ackerman's 11/12/10 piece in the Washington Post if you want to learn a thing or two about the 20th Amendment. "It is uttterly undemocratic for repudiated representatives to legislate in the name of the American people." And Ackerman is a progressive.

I learned a lot from it as well. Ackerman's point is that the 20th Amendment was intended to limit lame-duck activity to true emergencies. Congress hasn't distinguished itself this month, that's for sure.

But there has to be some sort of transitional period. Move to Washington, hire staff's, clean the office, collect the damage deposit, etc.

Since determining what constitutes a national emergency requiring a lame duck session is somewhat subjective, it seems the founders had it right to begin with.

DeMint is right on a host of issues. and he is one of the few politicians that sticks to his principles on fiscal issues such as not asking for earmarks even when a host of SC politicians are begging him to do so. But like most politicians he suffers from foot in mouth disease and like most conservative politicians he turns my stomach on social issues.
