Don't do that, like with this guy (and he's done multiple prison stints) and you get criticized for not holding a person longer. The Philly DA is Larry Krasner (was a former defense attorney) and he came into office preaching the concept of less or no prison time and lessening the severity of most of the criminal justice code. It would seem this guy's past track record is an example of how that idea could go wrong.

No one is in prison for simply smoking pot.

He is correct. Nobody is in prison for just smoking pot.

Simple possession of marijuana, in the worst of circumstances in the strictest states is not an offense that will land you in prison. Anyone you find in prison with marijuana charges is there for trafficking level offenses, or they were in possession of a firearm in the commission of a crime, which boots you up to the Federal level.
