Go to a Spokane street corner and blow a whistle as loud as you can for a couple minutes, then scream obscenities for a couple minutes, and get back with us.
Are those things violations of federal law? No.
Can ICE/CBP cite, arrest, or detain someone for doing them? Not unless they are directly obstructing their operations. Being an annoying nuisance is not directly obstructing.
First Amendment protections matter!
- Speech (including profanity) is protected
- Expressive conduct is protected
- Government cannot criminalize behavior just because officers dislike it
ICE/CBP can request local assistance but it's up to locals to decide if local laws might have been broken and to enforce them if they have.
I thought Republicans were opponents of big federal government and supporters of state and local government control.
