You are correct, I don’t know how those jack-booted authoritarian thugs go about raiding a workplace.

And you don’t deny not giving a shit about the Constitution.

:D

Wrong.

And I’m not the one stuck on stupid saying the ICE raids violate the Constitution.
My arguments that they’re violating searches & seizures (4th), due process (5th) & equal protection (14th) are just as valid/strong as any you might have that they aren’t.

Sounds like you’re the one that needs help in understanding that ICE isn’t violating due process. The INS and now ICE has been conducting workplace raids since the Immigration Reform and Control Act (IRCA) of 1986, which made it illegal for employers to hire illegals. SCOTUS recently upheld this authority to conduct raids 6-3.

”At this preliminary stage, the Government has failed to identify a source of authority that would allow the military to execute the laws in Illinois,” the unsigned order reads.

The court explained that to justify calling up the National Guard, a president must be unable to execute laws with the regular forces of the U.S. military.

That would require “exceptional” circumstances because of the Posse Comitatus Act, a centuries-old law that generally bars federal troops from participating in civilian law enforcement.

While the administration alleges “substantial interference” with the Department of Homeland Security’s (DHS) ability to enforce federal immigration law, Illinois and Chicago officials told the high court there is “no credible evidence” to support such a conclusion.

“Instead, the evidence shows that federal facilities in Illinois remain open, the individuals ‘who have violated the law by attacking federal authorities have been arrested,’ and enforcement of immigration law in Illinois has only increased in recent weeks,” they said.

Court emphasized that it was not issuing a final decision on whether or not the president has the authority to deploy the National Guard. It focuses on the emergency request before the Court while side-stepping the overall issue, which is not out of line with other recent rulings.

The Court made clear in its decision that it is not addressing the underlying constitutional questions, nor is it making a determination as to whether or not Trump's orders were lawful. It also, notably, does not prevent future deployments.

If this were all true, the court was and is still wrong. The constitution is quite clear.

Under what authority did they bust into the bathroom? Were ther exigent circumstances?

They were there under a document (i.e. administrative) warrant which allows them to inspect employment records and enter non-public areas to the extent necessary to obtain those documents. They didn't need to enter the bathroom to obtain those documents. A workplace is private property. They likely needed a judicial warrant to further search the workplace, including the bathroom.

Good to see that you noticed the similarity between that SCOTUS ruling and the National Guard ruling that you posted about at the same time.

I’m pointing out facts that a 9 year old can understand. You’re responding with the OPINIONS of corruptible, flawed, and political judges. You’re reduced to quivering vagina every time dear leader is criticized using FACTS and common sense.

Does nicky sortor understand that under Posse Comitatus, trump would need to justify deploying the Marines? He'd most likely attempt to use the Insurrection Act which would almost certainly lead to litigation and delays.

If federal property in the city of Chicago was being attacked, the Chicago PD refused to help stop it, and the limited # of Fed LEOs there weren’t sufficient to protect it 24/7 against the leftist mobs, that would be the justification. The National Guard would be the obvious choice, but Congress wrote the statute to say ‘regular forces’ must be used before the NG. Blame Congress for getting it backwards, or at least not being clear as to what they meant.

Sure, they can protect federal property but they can't go on patrol, engage in crowd control, perform searches, etc. In other words, trump can't turn them loose on American patriots like an invading force.

'Arrest first, ask questions later': Judge orders on-the-spot release of Beaverton man that CPB detained without a warrant

This Court is becoming all too familiar with Respondents’ self-apparent tactic of 'arrest first, ask questions later,' which is the crux of the violation of Petitioner’s Due Process rights here," McShane wrote.
