Good point.....though looking at the video, I don't believe you can actually see the bullets from his gun enter the perp...how do we know the perp wasn't so distraught, he shot himself 5 times....a tchnicality, yes, but technicalities work both ways....probation....native wrote:...shows he was still stressed out from having his life threatened. I give him probation.Appaholic wrote:What a dumba$$.....can't believe he forgot to turn off the security camera when he went to fetch the second gun....deserves to go to prison for his stupidity alone.....

But I don't think it should be first degree murder.
I really just don't have any sympathy for those that commit armed robbery.
I see it as two separate issues.
I have no sympathy for the deceased. If the first shot killed him the pharmacist would be off the hook for acting in self defense and the teen got what he deserved.
But the pharmacist didn't have to go back and execute him after the threat was over.
However, if I were the prosecutor I don't think I'd try the pharmacist for first degree murder. I think his defense would be able to make a reasonable argument that he was still amped up for having a gun pointed at his head and wasn't acting clearly.

Armed or not, the moment this kid decided to walk into this business he became an accessory and he unfortunately paid a very steep price. Murder 1 would be hard to pin on this guy since he was clearly responding to the situation that presented itself. You have two kids with masks, one's pointing a gun at you so you assume the other is packing also. He'll likely get manslaughter at worst, maybe an extra slap on the hand for coming back and finishing the guy off.
I'm certainly not advocating that he handled it the best way, but who are we to judge how we think we'd react when presented with the same situation?

The execution part is where I just don't feel bad for the guy anymore. You don't need to put 5 shots at point blank into a guy half dead on the floor. He won;t get 1st degree but he'll do time. He'd get a better sentence in a smaller city or town.

That was a waste of ammo. And if one is to believe all the gun nuts, that ammo is soon to be in short supply
Better to just drag him out back, toss him into the dumpster, and let him bleed to death.

Lesson for all; If you are going to shoot someone, make damn sure you kill them. This thing is going to blow over after creating quite a mess, but they are not going to jail the druggist for shooting down an armed robbery hoodlum with a criminal record, end of story. Now, if the hood was just critically wounded, there would be a never ending stream of torment and legal battles ahead for the druggist, enough to lead him to financial ruin. He did right, and let's just see if his place gets hit again in the future.

Self defense whether we like it or not ends when the attack has been successfully repelled. After that it was murder. Too bad he carried it that far and although I agree that the teen won't be doing that again I just can't help but feel that I would be outraged if a fella had the opportunity to repel an attack from someone I know and then proceeded to murder him out of spite.
Self defense is great.
But when you chase one suspect out of the store, leaving behind two innocent customers, then return, walk past the downed robber, turn your back on him, and then execute him with 5 gun shots, you just committed murder.
Yes, the robber was in the wrong. But to suggest he deserved to be executed is barbaric, and if that is how you want your justice, then I suggest you move to Saudi Arabia. That is NOT America.
If the first shot had killed the robber I wouldn't even so much as give probation to the guy. Even if the guy had used all of those bullets at once I'd say the same thing. The pharmacist needs to go to jail.
