imagine shooting yourself and getting 2 years in jail, but knowing Stallworth killed a man and got a slap on the wrist. Talk about the ultimate kick me in the ass moment for Plax

Sounds a little severe, but hey, I think its pretty clear that you don't bring a gun to a club in NYC.

This also makes me think of that article that was posted earlier in the locker room... what about that guy who had the unlicensed shotgun, discharged it killing two and wounding others. Is it ok that it was in self defense? I thought that the laws were strict and that's why Plax got the two years... so it's cool to illegally poses a gun in NYC as long as you only use it in self defense, check.

Apples and oranges really.
The shopkeeper had the shotgun locked up in his store.
Burress brought a concealed handgun to a crowded public place.
The use of the weapon wasn't what got Burress jail time, IMO.

Yup, the concealed thing is one aspect... but both guns were unlicensed and both were shot off within city limits. Still illegal possession of the firearm. But you're the lawyer soooo you probably know this law/the NY law better than I dodanefan wrote: Apples and oranges really.

The gun laws of NYC are very strict. Unlike the rest of NY state, it is nearly impossible to get a concealed carry license in NYC unless you are a Police officer (from another jurisdiction) or a peace office. You can get a license rather easily for a residence or business permit which allows you to keep a weapon in your house or your business. That is pretty common. But once you take it out of the licensed location, your f'ed.
Concealed carry in NYC is highly prohibitted and the city makes that very clear. There are advertisements everywhere (subway, etc...) pointing out that unlicensed concealed weapons will be prosecuted to the fullest extent possible which includes the recomendation of jail time. Burress wasn't being made the example of that everyone is claiming. He got what any other schmuck off the street would have gotten had he shot himself with an unlicensed concealed pistol in a NYC club.
The other thing is this - NY does not have reciprocity for other state gun laws. If you aren't a resident of NY you cannot carry a concealed weapon in NY. With some exceptions for security officers (armored cars, etc.) nonresidents cannot even apply for a NY permit either.
Upstate NY is much more liberal on gun laws (actually I guess that makes them conservative) as you don't need a license for anything but a concealed carry pistol.
