If true, this flushes the whole "he declassified them" argument down the drain.It’s a little confusing – there’s been much talk in the media about classified information. Improper storing of classified information is a crime, but that is not what is being investigated here. A much more serious crime under the Espionage Act is at stake.
Even someone like a former president who initially had lawful possession of national defense information commits a felony by retaining that information after the government demands its return. Trump can not hang on to national defense documents even if, while president, he “declassified” such documents, as he claims he did.

One thing I wish we would learn as a nation from this is that we give way to much latitude and power to our Presidents. This is one more example of it. There is no way there should even be a question that what he did in this case is a violation of the law and he should go to jail for it. Also, a President should not be able to unilaterally de-classify things. There should be a process prescribed by law and things should be declassified through that process. The "Nation of Laws and Not of Men" thing should apply here.
Whether one thinks Trump is a threat or not (as I do), just as a general matter we should not have a system where a President COULD declassify a bunch of sensitive stuff then take it out the door with him so that he could use it to do things like attempt to make money with the information.
There are all sorts of other things associated with our allowing Presidents too much deference and power. That extra-Constitutional idea that they can't be prosecuted for a crime or subject to civil lawsuits while they are in office is one thing that comes to mind. But this unilateral authority to declassify is what's in the news right now.
The President is not a king. They are the chief executive of the Executive Branch. They should be subject to all of the laws and restrictions that any other citizen is subject to. Frankly, I think they ought to have to get a security clearance like any other citizen authorized to look at top secret information has to go through and if they can't get it tough. If they couldn't get through whatever the process is that leads to a security clearance they shouldn't be President. The fact that they are the Chief Executive does not...at least should not mean...that they are not subject to all of the rules and restrictions that everybody else in the Executive Branch is subject to. And that includes all the Ethics rules and restrictions.

Sandy Berger stuffed 5 docs into his socks and pants, was charged with unauthorized removal and retention of classified material from the National Archives, and got a 50k fine & 2 yrs probation..
