The judge was dumb in that case, they should've known better not to conjecture from the bench and not to say something that factually, based on the jury findings, wasn't true. Saying stuff like that is what can and still could lead to the conviction being overturned. Unlikely, but still shouldn't have opened the door to it. As for the charge, it was a civil case, not criminal, and Trump was held liable for sexual abuse (as well as defamation). That still stands today and was what I was referring to.
Note conviction to overturn, but civil judgement.

Of course it was dumb. Just like Big ‘I‘m going to get Trump‘ Leticia James unprecedented mortgage fraud case against Trump was completely tossed by a democrat dominated NYS appeals court, I believe the other 2 NY cases will eventually be as well (maybe after Trump is out of office), because they were all set up to get Trump. The DC and FL cases had more to stand on than the 3 NY ones, but yet the NY ones ended up with 1 conviction and 2 Civil judgement (with one tossed so far).

With the Carroll case:
-The NY state legislature had to pass a special get Trump law created extending the statute of limitations to bring civil cases so this civil case from way back in the 1980s could be brought against Trump.

-A high powered, major donk donor attorney was brought on by the donks to run the case.

-The case was filed in about as hostile a jurisdiction against Trump you could find so you had a lefwing claimant, judge, & jury pool.

Trump was found liable for sexual abuse DESPITE:
-ZERO physical evidence.
-ZERO corroborating witnesses.
-Carroll couldn‘t even remember the year the alleged incident took place.
-Observers pointed out literally dozens of inconsistencies in her story.

Doesn‘t matter. This civil judgement against Trump was baked in before the case even started.

So if someone who committed a crime of crossing the border illegally is arrested for being in the US illegally (civil violation) that doesn‘t mean they didn‘t commit a misdemeanor criminal violation of EWI.
