Rather than being granted asylum, most were forcibly returned directly to Haiti, while thousands more were detained at the U.S. naval base in Guantanamo Bay before eventual repatriation

During the violent years of 1991-1994, many thousands of Haitians crowded into unseaworthy boats in an attempt to seek asylum in the United States. Continuing the policy of his predecessor George H.W. Bush, the Clinton administration responded to this massive wave of immigration by interdicting the refugees at sea and repatriating them back to Haiti. This Haitian refugee policy went through many changes and legal maneuverings in U.S. courts in response to a public relations campaign by human rights activists. Eventually more than 30,000 Haitians were detained in a legal limbo at the U.S. naval base in Guantanamo Bay, Cuba.

This whole concept of “Power” has been fought over for nearly 100 years, going all the way back to Franklin Delanor Roosevelt, where a large slice of his Power was taken away. He fought to regain it, even wanting to “pack the Court,” but was unsuccessful in doing so. This Decision gives tremendous additional Power back to the Presidency, where it belongs. It is an Honor to be the sitting President who, after all these years, WON this very important, and hard fought, Case.”

Kavanaugh claimed that the Constitution's meaning has changed because "significant illegal immigration into the United States is a new circumstance that was largely unknown as of 1868".

Thomas claimed that the 14th Amendment's citizenship provision applies only to the children of people who are "domiciled" in the US and not to the children of "temporary visitors." This theory appears to have no basis in the text of the Constitution, which, again, refers to "jurisdiction" and not domicile.

How could any justice who considers themselves an "originalist" make these claims? What would Scalia say?

How would MAQA react if Kavanaugh's logic were applied to the 2nd amendment - "semiautomatic rifles, high-capacity magazines, school shootings, and mass public shootings are new circumstances that were largely unknown as of 1791"?
