Facts Elusive, Rumors Will Rule Shuler-TVA Saga

In April of 2005 two investors bought property along Watts Bar Lake in Tennessee. Before the sale, the Tennessee Valley Authority, which controls access points on the lake, told the investors they had access. TVA was wrong.

Last year the agency and a development group that had taken over the property worked out a deal whereby the developers would get 146 feet of access for a dock and boat ramp. In return, the developers ceded access rights on 150 feet of other frontage they owned, and agreed to put up $15,000 to help stabilize shoreline in another part of the lake.

Sounds routine. It would be, except for one matter. Heath Shuler was one of the developers. In fact, he had bought out the original investors. At the time he joined the group in 2005, he was a private citizen. By 2008, however, he was a U.S. representative and a member of a subcommittee that oversees TVA.

In all honesty - this doesn't seem that scandalous - and it sounds like a result that could have, and likely would have, been reached with any land owners in such a situation... the TVA got something of value, the land owners did too... who exactly loses here? agencies like the TVA make deals like this all the time - basically what the agency got was 15k of erosion protection they didn't have in the budget in a 1 for 1 land swap...
