It would have been hard Monday for Rep. John Conyers (D-Michigan) not to understand how Bill Ayers felt the day the World Trade Center and Pentagon were attacked. Unforgiving history records that on Sept. 11, 2001, the retired domestic terrorist's "I don't regret setting bombs" comment ran in a New York Times profile.
While obviously of a much lesser magnitude, the House Judiciary Committee chairman's May 4 statement exonerating ACORN couldn't have come out at a worse time. "Based on my review of the information regarding the complaints against ACORN, I have concluded that a hearing on this matter appears unwarranted at this time," Conyers said in a statement aired that night on CNN's "Lou Dobbs Tonight."
Just hours earlier his fellow Democrats in Nevada, Secretary of State Ross Miller and Attorney General Catherine Cortez Masto dropped a bombshell. ACORN and two former senior ACORN employees in the state, they announced, had been charged with a total of 39 felony counts related to voter registrations.
"By structuring employment and compensation around a quota system, ACORN facilitated voter registration fraud in this state," said Masto. "Nevada will not tolerate violations of the law by individuals nor will it allow corporations to hide behind or place blame on their employees when its training manuals clearly detail, condone and, indeed, require, illegal acts in performing the job for the corporation."..
When on Wednesday this reporter asked Conyers spokesman Jonathan Godfrey to explain the decision not to move forward with a probe, he declined to do so and instead emailed the same statement that was aired on CNN earlier in the week.
It's unclear what exactly crystallized Conyers's thinking, but his reversal is all the more puzzling given the enthusiasm the 23-term congressman showed for holding an ACORN hearing mere weeks ago.
On March 19, after hearing the testimony of GOP lawyer Heather Heidelbaugh about ACORN's many misdeeds, Conyers said the allegations were "a pretty serious matter."
Back on March 19, Conyers seemed genuinely disturbed by the claims. He pushed the chairman of the subcommittee Sensenbrenner is ranking member of, Rep. Jerrold Nadler (D-New York), to hold his own hearing.
A blasé Nadler said he "would certainly consider a hearing on ACORN, if I ever hear any credible allegations." Referencing Heidelbaugh's testimony, Conyers replied, "Whoa. Wait a minute. This is a member of the bar here that got a successful partial injunction against ACORN."
A fortnight later Conyers reiterated his support for an ACORN probe, telling the Washington Times he still wanted to do it and he "probably will." Conyers, whom the article called an "unlikely champion" for ACORN opponents, rejected arguments from fellow Democrats that his committee should steer clear of the issue.
"That's our jurisdiction, the Department of Justice," he told the newspaper. "That's what we handle – voter fraud. Unless that's been taken out of my jurisdiction and I didn't know it."
Alas, it was too good to be true. The investigative zeal of the Judiciary Committee chairman soon waned.
It was always hard to believe that the ultra-liberal Conyers, who is very sympathetic to ACORN's policy goals and who as recently as October called the radical group "a longstanding and well regarded organization that fights for the poor and working class," really wanted to investigate his longtime ally in the leftist movement.
Conyers, who received a 100% rating from ACORN in its 2006 legislative scorecard, showed how truly in sync he was with ACORN when he spoke at the group's national convention last June 22.
"I'm through with deregulation," said Conyers. "It doesn't work because the capitalist predators who are waiting unregulated are going to take advantage of it."
Last fall Conyers seemed on hair-trigger alert, ready to pounce on anybody who tangled with ACORN. After media reports surfaced that one ACORN worker was assaulted by an irate homeowner, some ACORN workers were threatened, and two ACORN offices might have been vandalized, Conyers speculated –in the absence of any evidence that the incidents were connected— that a massive anti-ACORN conspiracy might be afoot.
"If true, these reports appear to describe possible federal crimes such as criminal civil rights crimes [sic] including conspiracy to deprive the victims (and others) of federally protected constitutional rights, mail and wire offenses, and other more basic offenses such as assault and battery," Conyers wrote in an Oct. 20 letter urging the attorney general and the FBI director to act.
"Depending on the circumstances and the possible involvement of a group of individuals, the conduct also raises serious questions under the federal RICO law," he wrote.
Yet the allegations of racketeering made against ACORN at the Judiciary Committee hearing in March don't seem to interest Conyers.

ACORN on Wednesday sued the duo who shot hidden-camera videos that are damaging the organization's reputation and the Web site that aired them, as the Internal Revenue Service broke off its partnership with the liberal community activist group...
...The lawsuit accuses James O'Keefe and Hannah Giles of violating Maryland law that requires two-party consent for electronic surveillance. It also names as a defendant the news Web site Breitbart.com, which first posted the video. The pair posing as a pimp and underage prostitute videotaped ACORN workers in Baltimore advising them how to cheat on taxes and loan applications.
The Association of Community Organizations for Reform Now (ACORN) is seeking a court order to prohibit further distribution of the videos and payment for compensatory and punitive damages.
"Although we do not condone what our former employees did, no matter how entrapped they were, we are also committed to our 500,000 members that we will hold the defendants civilly and criminally responsible for their violations of Maryland laws and for the damages inflicted upon ACORN's reputation," ACORN CEO Bertha Lewis said...

The IRS said it would eject ACORN from the agency's volunteer tax assistance program, which provides tax-preparation help to about 3 million low-income workers. The Obama administration also canceled plans for the group to help with the 2010 census two weeks ago when the videos surfaced.
ACORN has scrambled to regain Democratic support after the Senate and House last week voted overwhelmingly to block federal funding of the organization. In the past, Democrats steadfastly defended the group against conservative charges it skirts tax laws, violates election rules and commits other crimes while heavily supporting Democratic candidates and liberal causes.
The Justice Department's independent inspector general plans to review ACORN's grant funding from the department, and Republicans are pressing for similar probes in at least six other agencies and an investigation by the Government Accountability Office.

A private investigator says he found tens of thousands of sensitive documents dumped outside a California ACORN office just days after the state attorney general announced an inquiry into the community organizing group.
Derrick Roach, a licensed investigator based in San Diego, told FoxNews.com he paid an impromptu visit to the city's ACORN branch on Oct. 9 and watched from his car as a man tossed bags of files into a Dumpster outside the building.
After ACORN staff left for the day, he says, he searched the trash bin and discovered more than 20,000 documents he believes point to illicit relationships between ACORN and a bank and a labor union — as well as confidential information that could put thousands at risk for identity theft.
"We're talking people's driver's license numbers, dates of birth, Social Security numbers, credit card numbers, bank account numbers, tax returns, credit reports" — all tossed in public view in the Dumpster, he said.
In one document shared with FoxNews.com, an ACORN employee's name, address, date of birth, Social Security number and driver's license number were revealed, and photocopies of the employee's license and Social Security card were also included. Another document showed bank account information for a woman paying an ACORN membership fee by check...
...Roach also charged that the California Teachers Association, the state's largest teachers' union, was "funneling information to ACORN for political activity" — a relationship that he said would not be illegal but would require ACORN and the CTA to disclose fully.
"I've done some checking into the reports that have been filed for the CTA, for ACORN, and I'm not finding any of this information being disclosed," he said. He did not provide any documents illustrating the relationship to FoxNews.com.
CTA spokesman Mike Myslinksi said the union had no comment on documents it had not seen. "That's out of left field," he said.
Roach's accusation comes in the wake of a national scandal for ACORN, the Association of Community Organizations for Reform Now. Staffers were caught on tape this summer in six cities offering to help a pair of filmmakers posing as a pimp and prostitute to lie to the IRS and acquire illegal home loans.
ACORN fired an employee in its San Diego office, Juan Carlos Vera, after video surfaced of him offering to help the "pimp" and "prostitute" smuggle in girls from Tijuana, Mexico, noting that he had many contacts in the city who could assist in smuggling them across the border.
The group is now under investigation by a number of city, state and federal agencies, and Congress has cut off funding for the group.
On Oct. 1, California Attorney General Jerry Brown launched a state investigation of ACORN. It was just eight days later that Roach says he retrieved the sensitive files — timing he says he finds fishy.
"I think if you look at the timeline of events when the attorney general made the announcement, when the documents were dumped, I think that it's highly suspicious."

The docThe “Power Plan” is a very interesting document. First, it provides another example for how ACORN’s political operation thinks strategically. The plan is focused on impacting state legislative races to create momentum and a power base to effect political races next year.
The second interesting feature of the document is how overtly partisan it is. At the beginning of the document, ACORN makes clear its goal is to put the Democrats in charge of the state Legislature:
Second, become an influential organization by shaping a handful of strategic legislative districts that, by themselves, can change who controls the state legislature. In other words, by taking credit for controlling some swing seats that return state senate power to progressives in 2008 and the state house to progressives in 2010, ACORN may not have members in a majority of districts, but we will be seen as the force that is making Oklahoma a progressive state in the way that it was 100 years ago.
By using this power to win significant changes for working people, by the end of our 5 years, we will have legitimized the progressive takeover of the statehouse and head into 2012 with a real possibility of changing what Oklahomans look for and expect out of their Congressional delegation.
Consider this analysis from its top political priority, OK state Senate district #43, held by GOP Senator Jim Reynolds:
The district’s south half will prove difficult, with more Anglo, Republican, and military families. The half to the north will be more fruitful. The entire district is working class, however, so it could respond uniformly to the right issue. This is the one of ACORN’s two targeted districts with a minority population above 25%

Where exactly in that blog post does it say that ACORN didn't in fact offer underage brothel ownership advice to the "pimp" and "ho", or are you yet again blinded by the unimportant peripheral information and not focusing on the facts?
