Rape is illegal under the UCMJ. Because the UCMJ is a higher authority than this localized order, it would take precedence, provided that rape is proved. After Tailhook, there would be WAY too much backlash for a female service member (remember, there are MANY more service members than JUST soldiers) to be held responsible for her own rape. You get in trouble for getting pregnant while on deployment for the same reason you get in trouble for getting a sunburn bad enough to keep you from doing your duty. The military has to be able to count on all of its deployable servicemembers remaining deployable, outside of acts of God and accidents.

Getting pregnant while deployed is poor judgment at best and malingering at worst.

BTW- smacking a terrorist in the chops is against the rules, but it does not affect readiness, and there is a big difference. Trying to draw parallels is civilian thinking.

I haven't served in the military, but I think I might have heard somewhere that they pride themselves on strict discipline. Strict discipline would require consequences for broken rules, I'd imagine.

The Seals REQUESTED a court martial in lieu of an Article 15 (NJP) as is their right...they feel they have a strong enough case to avoid any punishment...it's a risk on their part, but one I agree with...

In this case, the General Officer in charge has issued a general order (note small g) to all his troops informing them that a court martial will be sought by HIM (The General) if a female soldier become pregnant and for the military male who impregnates a fellow military member (in Northern Iraq)...

If a female assigned to Northern Iraq goes home on leave and comes back pregnant, she is also liable under this general order...

A civilian female back home (wife/GF/SO) does not count...


To summerize, the Seals - Asked for a court martial...get prego, you are gonna get a court martial, no asking involved...

I'm still a little unclear about what rules were broken in that Seal thing to be honest. IF there is a rule that was broken, it sure sounds like a dumb rule that needs to be looked at. IF they did break one, then they will pay a price and that is what the court martial will do. I know if I was them, I'd probably request a trial as well. But I wasn't there and don't know what was or wasn't said or done so I can't say how bad they or their superiors screwed up. I do know the guy they caught deserves to have his sack cut off with a dull rusty knife so me feeling sorry for the guy is hard to dig up. The fact they didn't do that to him, is reason enough to think they did a good job capturing him since he is still breathing.
