Well, why does the police officer assign at least one person in every crash as "at fault"? They may call them accidents, but that's a misnomer - someone screwed up and caused the crash. Cars don't go out of control on their own (and if they do, if the Toyoya saga is to be believed, then the guy making or designing the car screwed up). There is always a root cause and it isn't just "shit happens".

Yep. I've been in two minor fender benders, neither my fault (clearly the other person's), both times in parking lots. I called my insurance company each time, who instructed me to call police, who told me that all collisions on private property are no-fault in Delaware and the insurance companies will decide how it's handled. In both cases, I paid my deductible to get my car fixed and was later reimbursed in full after my insurance company squashed theirs.

If you had NOT been on private property, I'd bet tickets would have been issued. In your cases, the law states that the police won't issue tickets on private property...

BTW- as trafiic offenses are not criminal (and therefore statutory)... states do not have jurisdiction on private property, and therefore traffic violations on private property are truly "no-fault." In other words, the police will not investigate.

The exception is when the offense rises above the statutory level to the criminal, i.e: reckless driving, vehicular homicide, etc. You can be as drunk as a skunk in your car in your driveway and it isn't DUI, for instance.

I'd be shorting BP stock right now if I wanted to profit from this mess. But I don't. I'd rather make sure there was a future for Gulf shrimp! :nod:
