What the hell is a "brunch break?"

And yes, what happened is total garbage considering they are at an American public school.
"I think they should apologize cause it is a Mexican Heritage Day," Annicia Nunez, a Live Oak High student, said. "We don't deserve to be get disrespected like that. We wouldn't do that on Fourth of July."
Seriously?

American flag t-shirts, bandanas, boxers, briefs, toothpaste, etc. are against the US flag code. The little redneck children should be taught the proper ways to respect the American flag. Covering yourself from head-to-toe in the stars and stripes is not the correct way.

Dude, the flag code is so outdated it's ridiculous. And to be honest, it just a flag. The issue is that AMERICANS in an AMERICAN public school were not allowed to show AMERICAN patriotism on a Mexican holiday that's not even recognized in AMERICA.

That isn't the point numbnuts. American students, at a public school in America were denied thier freedom of expression becuase they wore the flag. We all see the point they were making, but still the show of patriotism that was looked down upon would make our founding fathers call for secession like they did in 1776.

Please explain how the flag code is out-dated???

jelly, an American Flag on a tee shirt...depending on how it is displayed...may or may not violate the flag code...the bandanna definately does...

Never as apparel. (because it's tacky :kisswink: )
The flag should never be used as wearing apparel, bedding, or drapery.
Except as a patch
However, a flag patch may be affixed to the uniform of military personnel, firemen, policemen, and members of patriotic organizations.

Well, you can't wear the flag on athletic uniforms and it can't touch ANYTHING underneath it (people holding those giant flags at sporting events is a violation). Of course no one really follows these rules so it's not like it matters. I'm just saying there are so many of 'em for the general public to remember, that I'm sure if we were actually to enforce it with consequences, we'd have to cut down on the number of rules.

Right, the flag itself should never be used for apparel, bedding, or drapery.

Stupid all the way around.

Flag bandanas - tacky.
People offended by wearing a flag T-shirt - STFU

Question for the kids wearing the T-shirts - is this a normal part of their wardrobe, or did they get them just to be assholes on that day?

I'm guessing they have had these clothes and have worn them before.

The National Flag Code is one of those "funny" laws in that while it's a law, there's no consequences or penalties for not following it. As the flag burning debate showed, and the Supreme Court's interpretation solidified, there will never be strict guidelines on the use of the flag - the First Ammendment will always trump it until someone makes a Constitutional Ammendment to say otherwise, and that's not happening anytime soon. In the end, it's just a flag.

According to a different article:
The Morgan Hill Unified School District issued this statement: "In an attempt to foster a spirit of cultural awareness and maintain a safe and supportive school environment, the Live Oak High School administration took certain actions earlier today. The district does not concur with the Live Oak High School administration's interpretation of either board or district policy related to these actions."
Looks like the Board realized the administration screwed up.

Funny enough, Mexicans don't really even celebrate Cinco de Mayo - It's more of an American holiday:
In historical terms, the battle that communities across America are preparing to celebrate this weekend isn't that significant, says John Renteria, director of Centro Civico Mexicano.

The May 5, 1862, Battle of Puebla is barely even noticed in Mexico, Renteria said. But the celebration of the defeat of French invaders by an outnumbered Mexican army, led by a Texas-born general, is becoming distinctly American.

"It's become more of a cultural, commercial phenomenon in terms of building awareness and educating the public about the Mexican culture," Renteria said. "It's really a U.S. day, not a Mexico thing, and that's fine with us."

I understand the Code, and have abook on it (at home)...

As I said, regarding the tee shirt, it depends on how it is displayed...if the tee is total flag oriented...NO GO...

If it's a, say, white tee with the U.S. Flag screen printed in the center...one could argue it's not in violation of the Code...depends on how it's displayed...

One of the biggest violations (and I mean BIGGEST) is the auto dealers with the HUGE flags...in and of itself. no problem...it's when they include in their advertising "UNDER THE HUGE FLAG" that it is now in violation of the Flag Code...

"Expelled"? They were sent home to change, right? A bit less severe than "expelled", doncha think?

Yeah, yeah, yeah - freedom of expression and all that - look, these little pricks didn't do this for any love of country, they did it to piss off people. And they succeeded...

I agree with AZ here - there's no law against being a ******. What if the school decided to have a day where all the students wore blue and these ****** decided to show up wearing red? Or worse, what if the school had cancer awareness day and asked everyone to wear pink and these ****** showed up wearing all black? Dissent and individuality are still allowed, even if you're only doing it to be a *******.

This is not a law that should have consequences. Good taste and pride is all that it should take to enforce it.

You are a sharp guy and reading your statements on this is a bit disturbing. It shows that some things have lost their reverence. In the 70's & 80's you learned about proper flag etiquette in school. I think I went to at least two or three different 1/2 hr. sessions on how to properly care for the American Flag. There are some rules but to not remember them is my fault. I am the one that would be responsible for not knowing them. I can't believe that the youth think that the rules should be disregarded because there are too many of them and they don't hold any weight because it has went out of fashion.

As far as the topic goes I agree that these issue of suspending these kids is fucking ludicrous and there should be some action taken to slap the wrists of the ones that perpetrated this on the kids wearing the T Shirts.

I agree also that the kids if they were truly a fan of the American Flag should have known that it is not a proper to wear as a bandanna, a T shirt, a Poncho, or what the fuck ever else they were wearing it as.

Somebody needs to put thier foot about knee deep in young Ms. Nunez's ass...

Memo to you young Ms. Nunez: This is the United States, not Mexico, not Mexifornia, and Stinko De Mayo ain't a holiday here in the United States anymore than Independence Day is a holiday in Mexico. Therefore, we don't celibrate it, recognize it, and are sure as hell under no obligation to "respect" it. Instead of belittling a young man for exercising his consititutional rights that many of our ancestors gave their blood and lives to afford all of us, how about showing some pride and respect for the nation that is affording you the right to make such disrespectful and stupid statements such as the one you made about "respecting" Stinko de Mayo, you stupid little bitch.

My guess is that the Pledge of Allegience isn't recited and that there isn't an American flag flying outside the school either.

You could be right...

Or it could be that race relationships is always an issue at this school, and the administration was trying to stop a riot from occurring...

On another note, I was taught that respect for authority and their "reasonable requests" (and this to me was certainly reasonable, if wrong) in school was right up there with respecting the flag and definitely trumped any freedom of expression rights I might have - if the principal says change, then goddammit you'd better change and not be a snot-nosed constitutional lawyer wannabee, or else the only boot-in-ass that would occur would be my dad's boot and my ass...
