Argue the scientific/religious points of the discussion all you want, but the Constitution is meant to protect citizens from the government. A fetus, unlike its mother, is not a citizen of the United States. If states want to take up the issue that's fine by me, but I don't think it should be the concern of the federal government.

as for the the "states rights" thing... tell me again how a woman in New Jersey has more right to privacy than does a woman in South Dakota... the 14th amendment protects both equally.

Actually, I agree...I'm stirring the pot. But I also agree that the government is sending an inconsistent message by allowing abortion on demand while also allowing state's to charge people with double-homicide when a pregnant woman is murdered. I don't think a state should be allowed charge a double homicide based upon this inconsistency whereas Hen does & also offers the fact that state's can and do this practice is admitting the fetus is a person. And it's hard to argue with the inconsistent message being sent from the courts.

Even better, if a drunk driver kills a pregnant woman on her way to the abortion clinic, is he charged with double vehicular homicide, or does he get off with one and can actually charge the woman's family for services rendered?

Where the hell is the right to an abortion in the 14th amendment? That's what the problem is with militant pro-abortion folks...thinking the same concept of privacy should apply to an elective procedure with a very sticky ethical dilemma attached to it as it applies to emergency spinal cord surgery.
