In order to qualify for illegal in state tuition, they need to break three federal offenses, meaning three felonies.
List the felonies.
Illegal entry is a misdemeanor.
Working without documentation is a misdemeanor... though, there are efforts to make both working illegally or hiring an illegal a felony.
1st of all, most of these illegals have documentation.
"Illegal immigrants are not “undocumented.” They have fraudulent documents such as counterfeit Social Security cards, forged drivers licenses, fake “green cards,” and phony birth certificates. Experts suggest that approximately 75 percent of working-age illegal aliens use fraudulent Social Security cards to obtain employment."

Knowingly hiring an illegal is a felony:
Federal Immigration and Nationality Act
Section 8 USC 1324(a)(1)(A)(iv)(b)(iii)
"....A person (including a group of persons, business, organization, or local government) commits a federal felony when she or he:
* assists an alien s/he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him or her to obtain employment, or
* encourages that alien to remain in the U.S. by referring him or her to an employer or by acting as employer or agent for an employer in any way, or
* knowingly assists illegal aliens due to personal convictions...."
