ARCADIA - Dozens, and potentially hundreds, of gas stations around California are choosing to shut down rather than comply with a state mandate that would require owners to purchase new equipment to reduce vapor emissions at the pump.

The requirement, known as Phase II in the state's Enhanced Vapor Recovery Program, is set to go into effect in April. It requires gas station owners to individually purchase tens of thousands of dollars of equipment designed to prevent harmful vapors from escaping into the air when gasoline is pumped.

But smaller retailers say that the requirement puts an unfair burden on businesses that don't sell enough gasoline to offset the extra cost - and that don't contribute much to the problem in the

Among them is George Fasching, who after 31 years of selling gasoline at Fasching's Car Wash in Arcadia, stopped in December.

"I came to the decision that I was too small a volume operator to continue on with the expenses imposed by the bureaucracy of the state," Fasching said.

April's requirements would have cost him $35,000, he said. Fasching used to sell the gasoline as a convenience for his car wash customers, and blames the new regulations for forcing him to stop.

"It will have some effect on my business, but at least I have the relief that I don't have to deal with these people anymore," he said.

Arizona had storage tank rules that went into effect a few years ago - most old/small volume operators shut down then.

Still no shortage of gas stations anywhere around.


I would propose a couple of amendments - if volume was very low, then waivers could be obtained. If volume increased over xxxx gallons a month, then waiver would be revoked.

Second, get Pelosi to earmark some of the stimilus money to help mid-volume stations meet the deadline.

You don't know me. I've ran businesses. The last one, I had at least 8 months of operating reserves (as policy) as well as $100,000 in liquid reserves for emergencies. We also had a $300,000 line of credit if we needed it.

I run my home too. I have sufficient cash in a checking account and 6 months equivalent of pay in a savings account for emergencies. Saved my ass when we flooded last year.

Gas station owners should see the writing on the wall and be prepared. I want my government keeping an eye on polluters. It's much easier to deal with this now than to clean it up later.

Yup it already exists in Texas. Who cares if it puts some out of business. Gas stations make all their money in the convenience store anyway. Gas stations are like dry cleaners, there are way too many of them and it saturates the market. I don't know how many dry cleaners I have visited for my job that don't have a registration with the state. They say they can't afford it even though it only costs $250 a year. These are the same assholes that dump their dry cleaning chemicals out back and cost the state millions in clean up.

That won't work because people will find ways around loopholes. If these stores are selling such little gas anyway then get rid of the pumps. Their money obviously comes from selling beer and snacks.

One phone call to Mr. Phasching and I either come up with a plan to make this work for him or, more likely, I will figure out where he fukced up. Most successful business owner plan for emergencies and are also very active in their respective trade/lobbying groups. This should not have been a surprise to him.
