The State Board of Higher Education today asked Attorney General Wayne Stenehjem to seek a declaratory statement from the North Dakota Supreme Court declaring the Fighting Sioux nickname law adopted in April 2011 to be unconstitutional.

The vote was 7-1, with board member Claus Lembke dissenting. Early in the two-hour teleconference meeting, Stenehjem told the board that, in his opinion, “if this matter were to be brought to the Supreme Court justices, I have no doubt they would rule the law (requiring UND to keep the nickname) is in violation of the Constitution.”
In other words no petition will save the name if its found unconstitutional.

No. The same crew of head-in-the-sanders will just file recall petitions against the SBoHE.

Edit: several hours later I realize the SBoHE is probably appointed rather than elected and therefore not subject to recall.

They as in tribal council yes, they as in the whole tribe...who knows they didn't get a chance to voice their opinion like at Spirit Lake. It may come back at them at election time. But its over now, and in the hands of the SBoHE and Al "Crazy" Carlson. I just hope the ND Supreme Court says Crazy's law was unconstitutional and UND can move forward with a new name, and Carlson can be known as the WORST politician in ND history.

Seems like Native Americans featured prominently in the news footage of the nickname petitions being delivered to the secretary of state. I realize that was carefully choreographed but it was powerful nonetheless.

Why is the use of American Indian people as mascots and symbols offensive?
The continued use of American Indian people as mascots, logos, and symbols is wrong. It denies a race of people the basic right of respect. By tolerating the use of demeaning stereotypes, we desensitize and objectify people. When using a race of people as nothing more than mascots and symbols, we are teaching the next generation of non-Indian children that it is okay to participate in culturally abusive behavior.

Yates and tell them to discontinue the use of their nickname (Warriors), or to Solen, ND located on the Standing Rock Reservation and tell them their nickaname should be discontinued....their school's nickname is....SIOUX!!!! Also Lakes the demographic of Solen is 34% white, and 65% Native American so those white people shouldn't be denying the 65% of Solen their basic right of respect...correct?

Huh. In the short clip I saw, the only non-Indians were staff in the secretary of state's office. Of course, I don't live in your state and the one clip I saw wouldn't necessarily be a representative sample of all of the coverage.

BTW, I am half "Cajun" (my Mom) and I have absolutely no problem with the University of Louisiana at Lafayette having "Ragin' Cajuns" as it's mascot. In fact I think it's cool. And I would be shocked if you could find a single Cajun...half or whole...who thinks its offensive. And they do use cartoonish stereotypyical mascots. How people could give a crap about stuff like that is totally beyond me. Especially in a case like this where the idea is that the Sioux historically have been a brave and noble people. It's totally a gesture of respect. No doubt about it.

It's an ethnicity. "Cajun" is kind of short for "Acadian." The Acadians were run out of Canada by the English and a lot of them ended up in South Louisiana. Dale Lennon, head football coach at UND from 1999 to 2007, is the latest Fighting Sioux athletics figure to join in urging retirement of the nickname for the sake of the athletics program’s future.

Now head coach at Southern Illinois University, Lennon writes that he has “asked many athletes who are being recruited by top FCS programs including UND why had they had eliminated UND as a potential option.”

Those student athletes’ response, he writes, “was they had a negative perception of UND because of the NCAA sanctions.” And, he adds, “Opposing recruiters will continue to use the NCAA sanctions to their advantage.”
I hope the pro-nickname people take a hard look at reality.

FACT. The NCAA has not been open to accepting real information on the support for the Fighting Sioux. Passing the statewide referendum will communicate the widespread support for Fighting Sioux athletics which will make the NCAA take notice and reconsider its baseless position.

I switched sides on November 30, 2010. The NCAA deadline. I never bought into Carlson's law as neither did the NCAA. I would never sign a petition because of what the NCAA has said about our state laws. UND had to get 2 tribal approvals, they didn't, game over. I love the name and logo but I would NEVER destroy our athletics to keep it.

Florida State's Seminole tribe has pledged their complete support to the use of the mascot. UND can't say the same.
Utah's Ute tribe has given complete permission for Utah to use their name as a mascot. UND can't say the same.
Central Michigan's Saginaw Chippewa Tribe supported the move and won the appeal for CMU against the NCAA. UND can't say the same.

The other teams are professional and don't explicitly target any one specific tribe which makes it practically impossible for them to be sued as hostile or offensive. (I imagine the nation's collective native american tribes would be split on whether these teams' mascots should be altered if they were polled).
