Hope you don't mind if I take this issue by issue...

an allegation is just that... an allegation. I'm not passing judgment one way or another. If his office has done nothing wrong, it should be able to stand up to a simple investigation. His office is innocent until proven guilty... but that doesn't somehow mean that members of Congress asking the AG to investigate the accusations are treasonous.

Misuse of their authority by requesting DOJ to initiate an investigation without just cause for political purpose is subversion. Most importantly, their intent is to INHIBIT AND INTERFERE with a law enforcement agency's duties. That is a crime. Doing so with political motive subjects the four Congressional members to investigation for a breach in Oath of Office.

Suffice it to say, any investigation by the executive branch before Jan. 20 is not going to be given much weight... and for good reason. That said, it would appear that these incidents highlighted by Sojourners are not egregious to my eye... however, I'm not privy to all of the information that an investigation would find.

I wholly reject the assumption that anything that occurred prior to January 20th contains no validity, especially when it pertains to the FBI. The FBI is not subject to the same political ebb and flow as other govt. agencies, and the incongruity in your argument is that Bush has been SOFT on immigration enforcement. Had Arpaio been unlawfully "stepping" on toes in Maricopa, I am COMPLETELY CONFIDENT the FBI under Bush's Administration wouldn't have had any compunction about pursuing criminal or civil complaint against him/his agency. I'm not an apologist for the FBI, but suggesting that they're subject to the whim of politicians is inaccurate and insulting.

To say that an investigation is politically motivated is confusing... many investigations are prompted by political groups, on both sides. In this case, there seems little harm in looking in to the allegations to determine if there is in fact a problem... or a systematic, department-wide problem.

The harm is in the manner it is being conducted and the person overseeing the investigation, Assist. AG Lorretta King. I will wager my reputation that this is a hatchet job...King's resume is LOADED with similar cases...and I've personally witnessed similar gamebook attacks. Once a prosecutorially empowered government agency sets it's goal on destroying or punishing someone...it's virtually impossible to stop them without a mobilization of a HUGE political backlash or an army of attorneys and overflowing warchest. That's going to happen in Arpaio's case. He has a HUGE national political base, and some deep pocket supporters. DOJ is going to get their nuts wrapped around their throat before this is finished.

The vitriol, especially toward a group like Sojourners (a group I know very well) seems misguided. Their motivation is humanitarian, and while you may disagree with their goals... they seem motivated by genuine concern for human rights, and they've existed for many years to provide a "voice for the voiceless".

No vitriol. I know nothing of Sojourners other than they're a "Christian based" human rights organization. That does not, however, give them privilege to attack Sheriff Arpaio's character based upon two incidents neither of which support the accusations they have made. Further, their abuse of influence by mobilizing their readers/members into participating in a letter writing scheme to "justify" an unlawful request by lawmakers to initiate a criminal investigation, is no different than a moron making phony 911 calls. No offense has taken place, yet, arising from either ignorance or malice, the moron chooses to make a false report with the intent of creating a problem for or being a nuisance to the accused.
That too, is a violation of criminal law.

I've got no problem with investigating the matter. I've also got no problem rigorously investigating and trying to stop human smuggling and coyotes in the southwest. I frankly dont think it will stop illegal immigration... but that's not really the point.

I have a problem with DOJ investigating a matter which was investigated last year. That's sheer harassment. And when done with the intent to interfere with Maricopa Country Sheriff's Office enforcement of immigration laws, which it unquestionably is, then all parties involved become criminals complicit in a conspiracy.

Like you say, TTBF...if it's "no harm, no foul", then let the office of Special Prosecution conduct an inquiry into Congressmen Conyers, Lofgren, Nadler and Scott's actions, and return their findings to the House Ethics Committee...

House Judiciary Chairman John Conyers (D-Mich.) told CNSNews.com he is going to invite Maricopa County (Ariz.) Sheriff Joe Arpaio to testify in his committee about alleged abuses by the Maricopa County Sheriff’s Office in its enforcement of U.S. immigration laws. But a spokeswoman for Arpaio told CNSNews.com that the sheriff -- who has not yet received an official invitation to testify -- currently has “no intention” of appearing before Conyers’ committee.

The announcement of the Justice Department investigation followed a Feb. 12 letter that Conyers sent to Atty. Gen. Eric Holder and Homeland Security Secretary Janet Napolitano requesting an investigation of Arpaio and the MCSO.

Conyers was joined in signing that letter by three other members of the House Judiciary Committee: Rep. Zoe Lofgren (D-Calif.), the chairwoman of the Subcommittee on Immigration; Rep. Jerrold Nadler (D-N.Y.), chairman of the Subcommittee on the Constitution and Civil Rights; and Rep. Bobby Scott (D-Va.), chairman of the Subcommittee on Crime, Terrorism and Homeland Security.

“Specifically, we would like to know what actions your Department will take to ensure that Hispanic residents of Maricopa County are not subjected to racial profiling, unequal treatment at the hands of Sheriff’s Department personnel, or violations of generally accepted standards of confinement,” the congressmen said in their letter to Holder and Napolitano.

CNSNews.com spoke with Conyers after a Capitol Hill press conference last Wednesday, where he had been joined by representatives of ACORN, the National Day Laborer Organizing Network, and other activists groups. The press conference had been called so the groups could present a petition carrying 35,000 signatures that called on the Justice Department and Homeland Security to investigate Sheriff Arpaio for alleged civil rights abuses.

When asked if he had been briefed on specific evidence of racial profiling by MCSO, Conyers said: “No, no I haven’t been briefed on it. We are getting ready to hold a hearing on it.”

Rep. Lamar Smith (R-Texas), the ranking Republican on the Judiciary Committee, said he is worried that Conyers’ intended hearing is an attempt to discourage enforcement of the immigration law.

"Some Democrats seem to have forgotten that in America, you're innocent until proven guilty,” Smith told CNSNews.com in a statement. “I’m concerned that this hearing is an attempt to intimidate other law enforcement officials and discourage immigration enforcement. Democrats need to stop trying people in the court of public opinion--where there is no evidence--and let the Justice Department do its job without political interference."
