Given the practical power that police have to mess with us and the wide discretion they have in exercising it, an attitude of meek subservience may seem advisable. That expectation is not fair, reasonable, or compatible with the principles of a free society. But it is demonstrably safer than the approach that Bland took, which was based on the assumption that she was a citizen whose constitutional rights should not be blithely violated by an authoritarian bully with a badge and a gun. I do not by any means fault Bland for questioning Encinia's authority to order her around for reasons unrelated to her traffic offense, any more than I fault Jessica Cooke for questioning the Border Patrol's authority to detain her at an internal immigration checkpoint in upstate New York. To the contrary, both young women showed exceptional bravery in standing on their rights. But as the outcomes in those cases (an arrest and a Tasing, respectively) show, such resistance to arbitrary power is brave because it is dangerous.

Kelly Bradley crouched in the corner of his cell, cowering under a blanket, as five officers clad in riot gear barreled inside and jumped on him, pinning him face-down.

As they cuffed Bradley’s wrists and ankles, one of the officers, William Hamilton Wilson, reached toward Bradley’s face and dug his index finger into the inmate’s eye — several times —until he ripped out Bradley’s right eyeball. It happened swiftly, almost as if it was routine.

Afterward, the extraction team at Charlotte Correctional Institution was summoned to the commander’s office. Capt. Scott Anderson, a 23-year veteran of the Florida Department of Corrections, asked the officers what happened.

No one saw anything. No one heard anything. No one could explain how Bradley’s eyeball ended up on his cheek, dangling by a thread.

Cincinnati Police Chief Jeffrey Blackwell said he's seen the unreleased footage from a University of Cincinnati officer's body camera during last week's fatal shooting and "it's not good."

"The video is not good," Blackwell said. "I think the city manager has said that also publicly. I'll leave it there."

After meeting with faith leaders Monday morning, Blackwell spoke to WCPO about the shooting death of 43-year-old Sam Dubose by UC Officer Ray Tensing during a traffic stop.

"I don't want to put my personal feelings out prematurely," Blackwell said. "I just hope that the right thing continues to be done in this investigation and that we're able to move forward from this and allow this to be a moment of learning and teaching for our city."

City Manager Harry Black also spoke about the unreleased body camera video of the shooting.

"It's not a good situation," Black said. "It's a tragic situation, someone has died that did not necessarily need to die."

I have. In fact, at this very site I have in the past said that they are society's thugs. A necessary evil. And I've written that the nature of the job selects for a certain type of person.

I think they are given way too much latitude. I don't think they should be allowed to get rough with you just because you don't comply with their orders, for instance. The paradigm should be that you are a citizen of the United States and your State and the Police Officer is a public servant. You are innocent until proven guilty. They should not be allowed to get rough unless it is absolutely necessary.

The cost of resolving police-misconduct cases has surged for big U.S. cities in recent years, even before the current wave of scrutiny faced by law-enforcement over tactics.

The 10 cities with the largest police departments paid out $248.7 million last year in settlements and court judgments in police-misconduct cases, up 48% from $168.3 million in 2010, according to data gathered by The Wall Street Journal through public-records requests.

Those cities collectively paid out $1.02 billion over those five years in such cases, which include alleged beatings, shootings and wrongful imprisonment. When claims related to car collisions, property damage and other police incidents are included, the total rose to more than $1.4 billion.

On Monday, New York City agreed to a $5.9 million settlement with the estate of Eric Garner, whose death after being put in a police chokehold last summer sparked widespread protests.

City officials and others say the large payouts stem not just from new cases, but from efforts to resolve decades-old police scandals. In 2013 and 2014, for example, Chicago paid more than $60 million in cases where people were wrongfully imprisoned decades ago because of alleged police misconduct.

For some cities, the data show that cases have gotten more expensive to resolve. Philadelphia police have faced criticism for numerous shootings in recent years. Last year, the city settled 10 shooting cases for an average of $536,500 each.

They're time could be much better spent shaking down cars with out-of-state plates for potential civil asset forfeiture on I-10.

Good thing this incident was on camera.
A University of Cincinnati police officer was indicted on murder charges on Wednesday in the fatal shooting of a driver this month.

In the indictment handed down by a grand jury in Hamilton County, the officer, Ray Tensing, is accused of killing the driver, Samuel DuBose, during a traffic stop near the campus on July 19.

At a news conference, the county prosecutor, Joe Deters, said that Officer Tensing “purposely killed” Mr. DuBose after the officer lost his temper.


The death of Mr. DuBose, who was black, at the hands of Officer Tensing, who is white, joined a string of recent episodes — in Staten Island, Cleveland, North Charleston, S.C., and Ferguson, Mo., among others — that have raised hard questions about law enforcement use of force, and the role of race in policing. Video cameras have recorded many of the episodes and nonlethal encounters like the arrest of Sandra Bland, who died three days later in a Texas jail cell, offering disturbing evidence of the confrontations that often contradicts the accounts of people involved.

I'm sure by sheer numbers it will be proved out more of this is white on white than white on black. So when will that narritive be brought into play? Or heaven forbid, white on illegal.

The data contradicts widely held opinions regarding law enforcement and race. This perception is fed by the media which reports on incidents which involve race and often ignore those that don’t.
But you can find others. It looks like the ratio of Blacks killed to Black Population is higher than Whites killed to White Population. But there are still plenty of Whites killed by cops and we never see it making big national news headlines. And it could very well be that, all other things being equal, Whites are just as likely to be killed by cops as Blacks are. And part of that "all other things being equal" thing would involve how individuals respond when they are confronted by police.
